What's happening
This bill requires New York State-owned parking facilities to install and maintain free electric vehicle charging stations in a designated percentage of parking spaces.
Why it matters
Direct state investment in EV infrastructure. By mandating the installation, operation, and maintenance of free charging stations in state-owned facilities, the bill positions New York as a leader in EV adoption and signals a commitment to reducing transportation emissions.
Guaranteed free access for users. The law explicitly prohibits the state from charging users for electricity or usage at these charging stations, removing a potential barrier to EV ownership and potentially increasing demand for electric vehicles among the public and state employees.
Electrical capacity and future-readiness. The bill requires both open lots and garages to be equipped with sufficient electrical infrastructure (specific raceway sizes and power capacities per stall), ensuring that the facilities are future-proof and can accommodate further expansion of charging capacity as EV adoption grows.
Enforcement and protected access. It establishes clear signage and enforcement measures (including citations for violators) to ensure that only electric vehicles can use these spaces, preventing misuse and supporting a reliable charging network for EV drivers.

3. Pursuant to subdivisions one and two of this section, open parking lots and other open parking facilities shall be capable of supporting electric vehicle charging stations through an electrical raceway, no smaller than one inch, capable of providing a minimum supply of 11.5 kVA to an electric vehicle supply equipment (EVSE) from an electric supply panel. to it with the raceway. Such raceway and all components and work appurtenant thereto shall be in accordance with state, city and municipal electrical code.
4. Pursuant to subdivisions one and two of this section, parking garages shall be capable of supporting electric vehicle charging stations through an electrical raceway to the electric supply panel serving the garage that shall be capable of providing a minimum of 3.1 kW of electrical capacity to each charging stall connected to it with the raceway. Such raceway and all components and work appurtenant thereto shall be in accordance with state, city and municipal electrical codes.
5. The office of general services shall be responsible for the installation of any electric vehicle supply equipment. If such installation shall require the state to make upgrades to a facility's electrical supply equipment to safely and sufficiently power and operate the charging stations, the office of general services, if able, shall increase the electrical capacity of the existing system by installing new components as necessary. If the office of general services is unable to make such technical upgrades to a facility, the state may contract with a licensed electrician or similar service provider to upgrade the electrical capacity of said facility.
6. The office of general services shall be responsible for the maintenance, general upkeep and repair of any electric vehicle supply equipment. If the office of general services is unable to complete such maintenance or repairs, the state may contract with a licensed electrician or similar repair service to complete the necessary work on said equipment.
7. To ensure that electric vehicles that require the use of charging stations are the only vehicles allowed to utilize parking spaces equipped with electric vehicle supply equipment, the office of general services, or other appropriate agency, is required to install signage to advise drivers of such parking restrictions.
8. State, city and/or municipal policing authorities and/or parking enforcement are hereby authorized to issue citations or take any other appropriate action in the event of a violation of subdivision seven of this section in accordance with existing vehicle and traffic law and parking restrictions imposed by any parking facility in which the electric vehicle supply equipment is located.
9. The state of New York shall assume all costs of installing, operating and maintaining any electric vehicle supply equipment, including the cost of utilities associated with the charging of vehicles. The state of New York is also prohibited from charging an individual, who is authorized by this section, in any way, for the use of such electric vehicle supply equipment offered by a state owned and/or operated parking facility.

Justification
The number of alternative fuel vehicles on the road in both New York State and across the country has grown significantly over the past decade. Specifically, Plug-In Electric Vehicles (those that are powered by an electric fuel cell and can be recharged) are in increasingly high demand, and market forecast studies conducted by Navigant Research find that by 2022 2.3 percent of total vehicle sales in the United States are expected to be Plug-In Electric Vehicles (PEV's) and that New York State will sell 144,690 PEV's between 2013 and 2022.
Given the large number of PEV vehicles that currently are and will be on the road by 2020, it is cur duty as a national leader in renewable ener- gy to provide the citizens of this state, as well as visitors, with proper resources for them to recharge their vehicles. This bill will promote individuals who were previously concerned with charging station limitations within the state to purchase clean energy vehicles, both boosting the economy through increases in private and state taxable revenue on the sales of such PEV's. Lastly, this Legislation will bring New York State up to par with other energy efficient states such as California and Texas, who are already installing charging stations in an effort to promote clean and renewable energy and reduce carbon emis- sions.
