What's happening
This bill requires New York City to replace any public parking spaces removed for bus lanes or capital projects with equivalent nearby spaces and hold a public hearing before removal.
Why it matters
May slow or complicate bus lane and street redesign projects. by requiring the city to find and create equivalent parking spaces nearby, potentially delaying transit improvements or capital construction if suitable locations are not available.
Strengthens local input and transparency. by mandating public hearings and advance notice before any parking spaces are removed, giving community members more voice and time to propose alternatives or raise concerns.
Prioritizes preservation of parking for both commercial and residential uses. , which could address concerns from businesses and residents about loss of parking, but may also limit the city’s flexibility in pursuing transit and pedestrian-focused projects.
Applies only to projects initiated after November 1, 2019. , so it would not retroactively affect earlier bus lanes or capital projects, but could have significant implications for future urban planning and development in New York City.

Title of bill
An act to amend the vehicle and traffic law, in relation to offsetting publicly available parking spaces replaced by designated bus lanes or removed by capital projects in the city of New York and requiring a public hearing to be held prior to eliminating such parking spaces
Purpose
To alleviate the lack of parking spaces utilized to access businesses along Woodhaven Boulevard in Queens that have been reduced or eliminated due to the creation of SBS bus lanes.
Summary of provisions
Section 1 Amends Section 1111-C of the Vehicle and Traffic Law to add a new subdivision (M) to require the City of New York to dedicate an equal quantity of publicly available commercial or residential parking sports within a one block radius for each parking spot that is eliminated or removed.
Section 2 Amends subdivision 2 of Section 1642 of the Vehicle and Traf- fic Law to require that the City of New York convene no less than one public hearing within the bounds of the community board affected no less than thirty days prior to consider alternative parking placements. The City of New York would also have to provide a minimum of fourteen days notice prior to the public hearing.
Justification
Local businesses rely heavily on customer accessibility and parking availability. Certain city projects in the past have eliminated critical parking spaces, without replenishment, thus causing a great hardship on business owners to accommodate customers. Most recently, the Select Bus Service (SBS) fully took effect on Woodhaven Boulevard in Queens on November 12, 2017. The plan, which is part of the New York City Vision Zero program, seeks to bring increased reliability for bus passengers, as well as greater safety to pedestrians and motorists.
However, a major part of the redesigned roadway along Cross Bay and Woodhaven Boulevards was the elimination of public parking spaces along the route. This feature of the new system is having a direct detrimental impact on the small businesses located along the route, as customers are not able to gain access to these merchants.
Since small businesses are the heart of the thriving economy of this community, ample parking must be made available. This legislation requires that the City of New York provide an equal quantity of alterna- tive parking spaces for the parking spaces that have eliminated in order to accommodate the buses.
