What's happening

This bill allows the Cayuga County jail to detain people under arrest awaiting arraignment in any court in the county.

Why it matters

  1. Could streamline law enforcement processes. by allowing all police agencies in Cayuga County to bring arrestees awaiting arraignment to one central facility, potentially reducing delays and transportation burdens.

  2. May improve safety and oversight. for people under arrest, since the county jail is likely better equipped, staffed, and regulated than smaller local holding cells or police lockups.

  3. Could impact the logistics and costs for local governments. by shifting pre-arraignment detention from multiple local sites to the county jail, possibly leading to changes in staffing, transportation, or facility needs at both the jail and local police departments.

  4. Raises questions about detainee rights and access. centralizing pre-arraignment holding could affect how quickly arrestees see a judge, access attorneys, or maintain contact with family, depending on the jail’s location and procedures.

Title of bill

An act to amend the correction law, in relation to authorizing the Cayu- ga county jail to also be used for the detention of persons under arrest being held for arraignment in any court located in the county of Cayuga

Purpose of general idea of bill

To allow Cayuga County to hold persons who are under arrest prior to their arraignment.

Summary of provisions

Section 1. Section 500-a of the Correction Law is amended by adding a new subdivision 2-t, allowing the Cayuga county jail to detain persons awaiting arraignment in any court in Cayuga county.

Section 2. Section 500-c of the Correction Law is amended to state all provisions of this section shall apply in any case where a person has been committed to the custody of the sheriff and such person may be held in the Cayuga county jail.

Section 3. Provides for an immediate effective Date.

Justification

This legislation was requested by Cayuga County.

Cayuga County is a rural county, comprised of small towns with few employees. When someone is arrested, especially outside of normal busi- ness hours, it can sometimes be difficult and time consuming to locate legal counsel and an available judge.

This bill would allow individuals who have been arrested to be housed on a temporary basis at the Cayuga county jail, allowing the County to adopt a streamlined procedure to assure that detainees will have access to adequate legal counsel prior to arraignment.
