AN ACT to amend the public authorities law, in relation to prohibiting the metropolitan transportation authority from listing a gender on commuter tickets
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. The public authorities law is amended by adding a new section 1266-l to read as follows:
§ 1266-l. Prohibition of gender information on commuter passes, tickets or fare cards. Notwithstanding any contrary provision of law, the metropolitan transportation authority is prohibited from listing a gender on any commuter pass, ticket or fare card as a means of identifying the owner of such pass, ticket or fare card.
§ 2. This act shall take effect immediately.

Summary of specific provisions
Section 1. The public authorities' law is amended by adding a new 2 section 1266-k to read as follows:
3 § 1266-k. Prohibition of gender information on commuter passes, tick- ets or fare cards. Notwithstanding any contrary provision of law, the metropolitan transportation authority is prohibited from listing a gender on any commuter pass, ticket or fare card as a means of identify- ing the owner of such pass, ticket or fare card.
Justification
The listing of a person's gender on public documents discriminates against the transgender community and must be removed. To deter sharing of passes, purchasers of some multiuse tickets must pick either male or female, clerks selling tickets at rail booths determine a purchaser's gender based on appearance, and train employees might not honor passes in cases of mismatch. This legislation seeks to protect the privacy of this large and vulnerable group of people by prohibiting of gender information on commuter passes, tickets or fare cards.
