What's happening

This bill repeals subdivision 6 of section 11-0907 of New York's environmental conservation law regarding restricted land areas.

Why it matters

  1. Repealing subdivision 6 removes a specific legal restriction. on how certain lands designated as "restricted areas" can be used or accessed, potentially opening these lands to new activities or management approaches.

  2. The change could impact environmental protections, land use, or recreation. , depending on what subdivision 6 previously regulated—meaning stakeholders like hunters, conservationists, or landowners may see changes in permissible activities.

  3. Immediate effect means any current prohibitions or permissions granted by subdivision 6 will cease as soon as the bill becomes law. , possibly requiring agencies and the public to quickly adapt to the new regulatory landscape.

Title of bill

An act to repeal subdivision 6 of section 11-0907 of the environmental conservation law relating to land designated as a restricted area

Purpose or general idea of bill

Repeals subdivision 6 of section 11-0907 of the environmental conserva- tion law relating to land designated as a restricted area

Summary of provisions

Section 1 repeals subdivision 6 of section 11-0907 of the environmental conservation law.

Section 2 sets the effective date.

Justification

The Alcove Reservoir in Coeymans, New York serves as an important compo- nent of the Capital Region's regional watershed system. The site is rich in vegetation and has become a source of revenue as a carbon sink for the City of Albany, which owns the property. Hunting and the taking of wild game is specifically prohibited in state law, which over time has become problematic for the management of the reservoir site. Hunting is permitted directly outside the boundaries of the reservoir and this "doughnut" effect has led to a major proliferation of the deer popu- lation on the reservoir property. The effect this has on surrounding vegetation puts the revenue the City of Albany receives for using the land as a carbon sink at risk.

This legislation would allow the taking of game in the Alcove Reservoir, which would enable staff to take measures to control the deer popu- lation. The bill would not open up the reservoir to hunting by the general public as access would remain restricted.
