What's happening

This bill requires manufacturers to establish collection and recycling programs for solar panels, wind turbines, and batteries in New York.

Why it matters

  1. Establishes manufacturer responsibility for end-of-life management. By requiring manufacturers to finance and operate collection and recycling programs, the bill shifts the burden of disposal from local governments and taxpayers to the producers of solar panels, wind turbines, and batteries, incentivizing manufacturers to consider product longevity and recyclability during design.

  2. Prevents landfill and incinerator disposal of renewables. The bill explicitly prohibits the disposal of these renewable energy components in landfills or incinerators, reducing the risk of hazardous materials leaching into the environment and aligning with state sustainability and waste reduction goals.

  3. Mandates transparent reporting and public education. Manufacturers must publish annual reports detailing collection and recycling efforts, outreach, and program costs, and conduct public education campaigns. This transparency helps regulators and the public assess program effectiveness and fosters broader awareness of responsible disposal.

  4. Creates a statewide infrastructure and compliance system. The bill requires the Department of Environmental Conservation to maintain a public list of compliant manufacturers and collection sites, and sets compliance conditions for wholesalers, retailers, and contractors, ensuring that only properly recycled equipment remains in the market and supporting the development of a circular economy for renewables in New York.

Who cares

  • New York solar panel, wind turbine and bulk energy storage battery manufacturers

They would have to finance and operate collection and recycling programs without charging participants, conduct outreach and submit annual reports.

  • Equipment wholesalers and retailers

They would be barred from selling covered equipment for final sale unless its manufacturer appears on the Department of Environmental Conservation’s website.

  • Building owners and installation and demolition contractors

They would have to deliver covered equipment replaced in buildings to collection sites and remove and deliver it before building demolition.

  • Waste transporters, landfills and incinerators

They would face restrictions on handling and disposing of covered equipment, including bans on knowingly delivering it to landfills or incinerators or accepting it there for disposal.
