What's happening

This bill requires manufacturers to establish free recycling programs for out-of-service solar panels, wind turbines, and batteries, prohibiting landfill or incinerator disposal.

Why it matters

  1. Shifts responsibility for recycling to manufacturers. By mandating that manufacturers finance and operate recycling programs for solar panels, wind turbines, and batteries, the bill ensures that those who profit from these technologies also bear the costs and logistics of end-of-life management. This could incentivize better product design and more sustainable business practices.

  2. Removes cost barriers for consumers and local governments. The law explicitly prohibits manufacturers from charging fees to consumers for recycling, making it easier and more affordable for individuals, businesses, and municipalities to properly dispose of renewable energy equipment. This encourages higher participation rates and reduces illegal dumping.

  3. Establishes robust tracking, reporting, and public education requirements. Annual reporting to the state and publicly available educational materials will increase transparency about recycling rates and program effectiveness. This data-driven approach allows for oversight, continuous improvement, and public accountability.

  4. Addresses hazardous waste concerns and landfill/incinerator impacts. By requiring manufacturers to manage hazardous components and banning disposal in landfills and incinerators, the bill reduces environmental risks associated with improper disposal, such as toxic leachate or air pollution, supporting New York’s broader environmental and public health goals.

Title of bill

An act to amend the environmental conservation law, in relation to enacting the "responsible renewable energy recycling act"; and providing for the repeal of such provisions upon expiration thereof

Summary of provisions

Section 1. establishes the title of the act as the"responsible renewable energy recycling act" and establishes definitions.

Section 2. sets criteria, for solar panel, wind turbine and battery collection; amends the environmental conservation, law to establish responsibilities of the Department of Environmental Conservation in relation to the collection of solar panels, wind turbine and batteries; amends the environmental conservation law establish requirements the Department of Environmental Conservation must adhere to; amends the environmental conservation law to establish restrictions to solar panel, wind turbine and battery disposal methods.

Section 3. states proper solar panel, wind turbine and battery collection disposal requirements placed upon any person, contractor, department, authority, instrumentality, municipal corporation of the state.

Section 4 sets forth the effective date and repeal date.

Justification

As residents of New York State switch to alternative forms of energy in order to reduce dependence on fossil fuels, we have seen a rise in the use of solar panels, wind turbine and battery storage systems. The immense growth of the renewable energy industry could lead to an accumu- lation of photovoltaic (PV) waste. The U.S Department of Energy projects the nation will have cumulatively installed 700 gigawatts of PV equip- ment.

Eventually, all of this equipment will reach the end of their life and become PV waste. These PV modules contain various valuable materials and rare metals, proper recycling will ensure that these materials and metals are able to be reused. By recycling renewable energy systems, we can ensure that these systems do not prematurely arrive at landfills where they can have potential negative environmental effects. It is essential that we take action that is both economically and environ- mentally friendly. In order to do this we must establish infrastructure to accommodate for the long-term management of renewable waste.
