What's happening

This bill requires all newly purchased and existing police vehicles in New York to be equipped with bulletproof or bullet-resistant glass.

Why it matters

  1. Increases Officer Safety. By mandating bulletproof or bullet-resistant glass in all police vehicles, the bill aims to provide greater protection for officers from gunfire and other ballistic threats while on duty.

  2. Significant Financial and Logistical Impact. Retrofitting existing police vehicle fleets and ensuring all new purchases meet the standard may require substantial funding and coordinated planning, particularly for smaller departments with limited budgets.

  3. Uniform Safety Standards. The bill requires the development of official specifications for what qualifies as "bulletproof" or "bullet resistant" glass, helping to ensure consistency and effectiveness of the protective measures across the state.

  4. Potential Service Disruptions. The law allows for phased installation so entire fleets are not taken out of service simultaneously, reflecting concern about maintaining police presence and response capabilities during the transition period.

IN ASSEMBLY

February 8, 2017

Introduced by M. of A. WEPRIN -- read once and referred to the Committee on Transportation

AN ACT to amend the vehicle and traffic law, in relation to bullet proof glass on police vehicles

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section 375 of the vehicle and traffic law is amended by adding a new subdivision 52 to read as follows:

52. a. On and after January first, two thousand nineteen, any police vehicle purchased by the state, a public authority, or any municipality must be equipped with bulletproof or bullet resistant glass.

b. The superintendent or chief of police, or other person responsible for the supervision and maintenance of a fleet of police vehicles, shall cause any police vehicle that is in use as of the effective date of this subdivision to be retrofitted with bulletproof or bullet resistant glass. Such person may cause such glass replacement to be performed on a staggered basis so that all police vehicles are not out of service at the same time.

c. The commissioner of the division of criminal justice services, in consultation with the commissioner of motor vehicles, shall promulgate rules and regulations determining the specifications that must be met to consider any glass as "bulletproof" or "bullet resistant".

§ 2. This act shall take effect immediately.
