What's happening

This bill allows student lifeguards in New York to work up to five hours before a school day with parental and school approval.

Why it matters

  1. Addresses Lifeguard Shortages. By allowing qualified student lifeguards to work earlier hours before school, the bill could help fill staffing gaps at pools and beaches, especially during mornings when finding adult lifeguards can be difficult.

  2. Emphasizes Academic Performance. Students must maintain satisfactory academic standing and provide a certificate from their school each marking period, ensuring that work does not negatively impact their education.

  3. Requires Parental and School Oversight. Employing student lifeguards under this exception is only allowed with written parental (or guardian) consent and ongoing school approval, adding extra safeguards for student well-being.

  4. Limits Scope to Certified Roles. The exception only applies to students serving as “qualified lifeguard or aquatic supervisory staff” as defined by state regulations, preventing this from being a broad exemption for any job before school.
