What's happening
This bill ensures that surviving spouses continue to receive workers' compensation death benefits even if they remarry.
Why it matters
Removes a financial penalty for remarriage. Surviving spouses will no longer lose or have their workers’ compensation death benefits converted into a lump sum if they remarry, providing ongoing financial stability regardless of their marital status.
Supports family stability and planning. The change allows surviving spouses—often with children or dependent family members—to better plan for long-term needs without fearing a sudden loss of benefits due to remarriage.
Aligns with evolving social norms. By eliminating the remarriage penalty, the bill acknowledges that financial support should not be contingent on whether or not a surviving spouse chooses to remarry, reflecting modern views on marriage and economic security.
Reduces administrative complexity. Removing the need to recalculate or pay out benefits as a lump sum upon remarriage simplifies the administration of workers’ compensation death benefits for both the state and recipients.
