What's happening

This bill prohibits the Long Island Power Authority from contracting with service providers or affiliates that own competing electric generation.

Why it matters

  1. Reduces potential conflicts of interest. By barring service providers (and their affiliates) who own competing electric generation from managing LIPA’s power supply, the bill aims to prevent situations where a provider might favor its own generation assets, ensuring decisions are made in LIPA’s best interest.

  2. May improve market fairness and transparency. The restriction could encourage a more competitive and transparent marketplace for electric generation on Long Island by separating the roles of those who generate power from those who manage LIPA’s power supply and planning.

  3. Could impact contract options and costs. Limiting eligible service providers might reduce the pool of qualified candidates LIPA can contract with, which could affect the cost or quality of management services—potentially leading to both positive and negative consequences for ratepayers.

  4. Strengthens local oversight of power supply decisions. The bill gives LIPA greater control over who manages its power supply and planning, which could allow for more independent and objective resource planning and procurement strategies.

Who cares

  • Long Island Power Authority

The bill would bar LIPA from authorizing its service provider to perform power supply management, electric resource planning or related services if the provider or an affiliate owns competing electric generation.

  • LIPA’s service provider and its affiliates

Their ownership of generation that competes directly or indirectly with generation in LIPA’s service area would disqualify the provider from performing the covered services.

  • Electric generators in LIPA’s service area

The bill would prevent a service provider with ownership ties to competing generation from managing LIPA’s power supply or electric resource planning.
