What's happening

This bill changes how franchise fees are calculated for racing corporations by increasing the operating expenses deduction from 45 to 365 days.

Why it matters

  1. Significantly increases the amount racing corporations can deduct as operating expenses from their franchise fee calculation, potentially reducing the fees they owe to the state. This change could free up substantial cash for the corporations, impacting state revenue from these fees.

  2. Shifts the financial balance between the state and racing corporations, possibly affecting public funds available for state programs supported by franchise fee revenue. If fees decrease, the state may need to adjust budgets or look for revenue elsewhere.

  3. May encourage greater financial stability or investment within racing corporations, since retaining more funds could be used for improvements, debt repayment, or other operational needs. This could have downstream effects on the industry’s health, employment, and local economies tied to racing.

  4. Creates a precedent for how franchise fees are calculated in other regulated industries, as this move redefines what constitutes a reasonable deduction for operating costs. Other industries might seek similar changes, potentially influencing broader state fiscal policy.

Title of bill

An act to amend the racing, pari-mutuel wagering and breeding law, in relation to calculating franchise fees

Purpose

To increase the amount of reserves the New York Racing Association (NYRA) can retain before paying 100% of their remaining funds to the state as their franchise fee.

Summary of provisions

Section 1: Amends subdivision 1 of section 208 of the Racing, Pari-Mutu- el Wagering and Breeding Law to increase the amount of reserves that NYRA can retain from forty-five days worth of operating cash to three hundred sixty-five days of operating cash before paying their remaining funds to the state as their franchise fee.

Section 2: Effective date.

Justification

NYRA has made tremendous strides in turning around the organization following the 2012 New York State Racing Franchise Accountability and Transparency Act, which overhauled the board and led to significant management changes. These changes have dramatically improved NYRA's financial position and this legislation is needed to ensure they have a proper level of reserves to address any unforeseen future issues.
