ACTING PRESIDENT VALESKY:Senator Kennedy to explain his vote.
SENATOR KENNEDY:Thank you, Mr. President.
I'm proud to rise in support of this important legislation to commemorate the life and sacrifices of the late New York State Trooper Kevin Patrick Dobson, Sr. He is remembered as a loving father and dedicated officer whose commitment to public safety always remained unwavering.
Trooper Dobson gave his life in service to the State of New York. He was struck and killed by a vehicle on the I-290, near the Colvin Boulevard exit, during a traffic stop in March of 2011.
His life was taken in the line of duty while he was working to keep our roads safe. Now it's up to us to ensure the memory of Trooper Dobson, and the sacrifices he made, live on for generations to come.
This legislation will designate the Interstate 290 bridge that crosses State Route 425 as the New York State Trooper Kevin P. Dobson Sr. Memorial Bridge. It will serve as a reminder for all Western New Yorkers that our highways were made safe by Trooper Dobson and his brothers and sisters in uniform.
It will memorialize the life of Trooper Dobson and help demonstrate our steadfast gratitude for the selfless actions of the hardworking men and women who serve in the State Police force and local police agencies.
In the days and months since his life was tragically taken in the line of duty, our community has sought ways to commemorate Trooper Dobson's service and sacrifice. The Trooper Kevin Dobson Memorial Bridge will complement the State Police efforts to commemorate his life with a new monument at the Clarence Barracks, where he nobly served.
Trooper Kevin Dobson was forever committed to his duty to protect and serve our community. He went above and beyond, always working hard to keep our roads and neighborhoods safe.
Today our thoughts and prayers go out to Trooper Dobson's family and friends, and we thank all those who have dedicated their lives to law enforcement. Trooper Dobson made the ultimate sacrifice, and the memory of that sacrifice and his over 13 years of service to this state will live on for years to come, as motorists every day cross the soon-to-be-named Trooper Kevin P. Dobson Sr. Memorial Bridge.
I had the opportunity to speak to Dick Dobson, the father of Trooper Dobson, a few weeks back when we introduced this legislation, and again today when I saw it was coming to the floor for this vote. The level of gratitude and appreciation felt by his family for this gesture is immeasurable, and I was asked to pass on this sentiment to this honorable body.
Trooper Dobson left behind children Kevin Patrick Jr., Jamie Kathleen, and Brooke Lauren Dobson, as well as stepson Andrew Hastings and life partner Bridgett Hastings.
I want to thank my colleagues for supporting this legislation, and I want to specifically thank the Western New York delegation as well as the chair of the Transportation Committee, Senator Fuschillo, for helping to bring this to a floor vote.
This was a collective Western New York effort to move this bill through the Senate, and I'm hopeful the Assembly will move quickly to pass this legislation and to move it to the Governor's desk for his signature.
I vote aye. Thank you, Mr. President.

I see that Senator Rules is not in the chamber at the moment, so I'm not able to direct this to the sponsor of the bill. As my colleagues well know, I am opposed to the sponsorship of bills by Senator Rules. I think that bills should be sponsored by individuals who helped to work on them.
This is a program bill of the State Comptroller's, and an important one, for Sandy Storm relief in my district and beyond and many districts around the state. So I will not vote against this bill, nor will I repeat this speech over the course of the next two bills.
But again, I would urge members of this house to do away with the poor practice of having Senator Rules sponsor bills when, for whatever reason, the leadership or certain members don't want to sponsor bills themselves.
I'll vote aye, Mr. President.

Senator Libous, that completes the noncontroversial reading of Senate Supplemental Calendar 53A.
SENATOR LIBOUS:Mr. President, can we go back to the active list for the day. And there's a controversial bill, Number 799. If we could take the controversial bill up at this time.
ACTING PRESIDENT VALESKY:On the active list, Calendar Number 799. The Secretary will place that bill before the house after ringing the bells.
The Secretary will read.
THE SECRETARY:Calendar Number 799, by Member of the Assembly Morelle, Assembly Print 6963B, an act to amend the Education Law.
SENATOR TKACZYK:Explanation.
ACTING PRESIDENT VALESKY:Senator Fuschillo, an explanation has been requested by Senator Tkaczyk.
SENATOR FUSCHILLO:Thank you very much, Mr. President.
In 2011 the Legislature unanimously passed a new law that for the first time would allow for the insurance coverage for the diagnosis, treatment and therapy for autism. And we all applauded that law, and Governor Cuomo signed it into law. And there was a big celebration because it was the first time in New York State that that would be made possible.
And I wish I could stand here and say we were the first in the nation, but we weren't. We followed other states. We were a little behind.
Part of that legislation, part of that law never required the licensing of applied behavioral analysts. Two days before the law went into effect -- and Senator Breslin, let me thank you for your support as well, because I know you were one of the coprimes on that bill.
It took effect November 1st of 2012. Two days before it was going to take effect, the New York State Division of Financial Services, the State Education Department and the Department of Health changed the intent. And what they did is they created a license for those who perform the services.
Well, New York State doesn't have a license. Only doctors or psychologists were licensed under New York State to provide these services. So those who didn't have this license that New York State created and changed the intent of the law were not allowed to apply for insurance reimbursement.
So the numbers of those who could apply went from about 700 individuals that were applying these services that could now be eligible for insurance reimbursement down to about 70.
ACTING PRESIDENT VALESKY:Senator Marcellino, why do you rise?
SENATOR MARCELLINO:I apologize for rising, but I'm having difficulty hearing my colleague because of the background noise. If we could get some order.
ACTING PRESIDENT VALESKY:If we could keep the noise down so that we could all hear Senator Fuschillo's explanation of his bill.
SENATOR FUSCHILLO:Thank you very much. Thank you, Senator Marcellino and Mr. President.
What the legislation does is it creates a license in two categories. And it really undoes what the state had done when they changed the intent of the law. And for the first time, once this takes effect -- and the Assembly just passed it unanimously today -- we will go back to the original intent back in 2012.
SENATOR TKACZYK:If the sponsor would yield for a question, please.
ACTING PRESIDENT VALESKY:Senator Fuschillo, will you yield?
SENATOR FUSCHILLO:Yes, I will.
And, Senator, thank you for your support. You and I talked briefly.
ACTING PRESIDENT VALESKY:The sponsor yields.
SENATOR TKACZYK:Yes, thank you for your explanation. I appreciate the bill and the work that it took to get it here. I just had two clarifying questions.
Under the bill, a new scope of practice is going to be created. But this scope of practice is only related to the treatment professionals, not the direct care workers. Is that correct?
SENATOR FUSCHILLO:That's correct.
SENATOR TKACZYK:And also, can you just explain how 853 schools and special education programs are impacted by this legislation?
SENATOR FUSCHILLO:They're not impacted by it. What the section does is it organizes them, under Chapter 853 under the Education Law, so they're considered charter schools. And those are the private schools that we see all over New York State providing the services right now.
SENATOR TKACZYK:Thank you, Senator Fuschillo.
On the bill, please.
ACTING PRESIDENT VALESKY:Senator Tkaczyk on the bill.
SENATOR TKACZYK:I think this is a great bill. I'm really happy to see it get to the floor.
According to the Centers for Disease Control, one in 88 children are diagnosed with an autism spectrum disorder. When we provide the ability for parents to get help from licensed behavior analysts, I think that's a very good thing. We're going to provide access to qualified providers and ensure good consumer protection for those families seeking that assistance.
I want to applaud the Senator, and I want to urge my colleagues to vote yes on this bill.
Thank you.
ACTING PRESIDENT VALESKY:Thank you, Senator Tkaczyk.
Seeing no other Senator who wishes to be heard, the debate is closed. The Secretary will ring the bell.
Read the last section.
THE SECRETARY:Section 16. This act shall take effect July 1, 2014.
ACTING PRESIDENT VALESKY:Call the roll.
(The Secretary called the roll.)
THE SECRETARY:Absent from voting: Senators Parker and Squadron.
Ayes, 61.
ACTING PRESIDENT VALESKY:The bill is passed.
Senator Libous, that completes the controversial reading of today's calendar.
SENATOR LIBOUS:Mr. President, I'm going to tell everybody what we're going to do now.
We're going to call an immediate meeting of the Finance Committee. We're going to ask the Finance Committee to go to Room 332 immediately. And the sooner they get there, there's a small agenda that they'll finish up pretty quickly, and then we'll come back and we have some nominees that are in the gallery today that we have to take care of.
And when that gets done, I'll let you know what the next step is.
ACTING PRESIDENT VALESKY:There is an immediate meeting of the Senate Finance Committee in Room 332 of the Capitol.
The Senate will stand at ease pending the return of the Finance Committee.
SENATOR LIBOUS:Mr. President, people can go to the Finance Committee, but I'd like to return to motions before we stand at ease.
ACTING PRESIDENT VALESKY:Motions and resolutions.
SENATOR LIBOUS:On behalf of Senator Zeldin, on page 22 I offer the following amendments to Calendar Number 622, Senate Print 5037A, and ask that said bill retain its place on the Third Reading Calendar.
ACTING PRESIDENT VALESKY:The amendments are received, and the bill will retain its place on the Third Reading Calendar.
SENATOR LIBOUS:Mr. President, at this time I would ask that the Senate stand at ease.
ACTING PRESIDENT VALESKY:The Senate will now stand at ease.
(Whereupon, the Senate stood at ease at 5:30 p.m.)
(Whereupon, the Senate reconvened at 5:48 p.m.)
SENATOR LIBOUS:Mr. President.
ACTING PRESIDENT VALESKY:Senator Libous.
SENATOR LIBOUS:If we can go back to reports of standing committees, I believe there's a report of the Finance Committee at the desk. I ask that it be read at this time.
ACTING PRESIDENT VALESKY:There is a report of the Finance Committee at the desk.
The Secretary will read.
THE SECRETARY:Senator DeFrancisco, from the Committee on Finance, offers the following nominations.
As member and chairman of the State Commission on Corrections, Thomas A. Beilein, of Appleton.
ACTING PRESIDENT VALESKY:Senator DeFrancisco.
SENATOR DeFRANCISCO: Yes. Are we on the first nomination?
ACTING PRESIDENT VALESKY:We are.
SENATOR DeFRANCISCO: Okay. I move the nomination of Thomas A. Beilein to continue as chairman of the Commission on Correction.
He's been there approximately five years. He is an outstanding citizen of this state. He's done a wonderful job. His background is outstanding. And he unanimously passed through the Committee on Crime and Corrections as well as the Finance Committee, and I proudly move his nomination.
ACTING PRESIDENT VALESKY:Thank you, Senator DeFrancisco.
Senator Gallivan on the nomination.
SENATOR GALLIVAN:Thank you, Mr. President. I too rise to support the nomination of Thomas A. Beilein to be reappointed as chair of the Commission of Corrections.
I've worked with the chairman in my capacity as sheriff of Erie County when he was the sheriff of Niagara County. He's an honorable man. I concur without repeating what Senator DeFrancisco has said about his qualifications.
He's been in the position and we've talked about the challenges facing the commission, and they're very real. And I look forward to working with him in the next several years in that capacity.
Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Gallivan.
Senator Maziarz on the nomination.
SENATOR MAZIARZ:Thank you very much, Mr. President.
I also rise to second this nomination of Tom Beilein from Niagara County, our former sheriff. Sheriff Beilein and I served together in the county together when I was the county clerk and he was the sheriff. I've known the sheriff for well over 20 years now.
He's done an excellent job as the chairman of the Commission of Corrections. This is a great reappointment by Governor Cuomo.
And during the confirmation process in both the Finance Committee and in the Crime and Corrections Committee, Chairman Beilein outlined very well the role of the commission and what they do and some of the accomplishments that he has had.
I'm also extremely impressed that Senator DeFrancisco rose to endorse this nomination, given the fact that Tom Beilein's brother John, the coach of the Michigan Wolverines, beat Syracuse. It was probably the one time that, you know, Syracuse was defeated, and Senator DeFrancisco still supports the opposition.
(Laughter.)
SENATOR MAZIARZ:Thank you very much, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Maziarz.
All those in favor Of reappointing Thomas A. Beilein, of Appleton, as a member and chairman of the State Commission on Correction signify by saying aye.
(Response of "Aye.")
ACTING PRESIDENT VALESKY:Opposed, nay.
(No response.)
ACTING PRESIDENT VALESKY:Thomas A. Beilein is hereby confirmed as member and chairman of the State Commission on Correction.
He joins us today in the gallery.
Congratulations. Thank you for your service.
(Standing ovation.)
ACTING PRESIDENT VALESKY:The Secretary will read.
THE SECRETARY:As member of the State Commission on Correction, Thomas J. Loughren, of McDonough.
ACTING PRESIDENT VALESKY:Senator DeFrancisco.
SENATOR DeFRANCISCO: Yes, I'm proud to also rise to move the nomination of Thomas Loughren as a new commissioner of corrections.
He went into great detail about his background before the Crime and Corrections Committee. If you haven't read his resume thoroughly, you really should. He's got an incredibly broad range of background that suits him particularly for this particular position.
And as a result, I do move the nomination and congratulate the Governor for this fine appointment.
ACTING PRESIDENT VALESKY:Thank you, Senator DeFrancisco.
Senator Libous on the nomination.
SENATOR LIBOUS:Thank you, Mr. President.
I too want to rise on Tom Loughren, because I had the pleasure of working with Tom when he was the sheriff of Chenango County. And he did a fabulous job there, he was extremely well respected. The men and women who worked for him, they liked him and they worked very hard.
He did a number of things when it came to not only just stopping crime but dealing with drugs and a whole host of things. And we worked together with some programs.
And I just think that the Governor has chosen as outstanding individual. I was very pleased when I saw his name come up. And Senator Gallivan asked me if I knew Tom, and I was very pleased to tell him that I do know him, he did a great job as a public servant as sheriff of Chenango County, and he will serve us very well on this committee.
So, Tom, I congratulate you, and I congratulate the Governor for this fine nominee.
ACTING PRESIDENT VALESKY:Thank you, Senator Libous.
Senator Gallivan on the nomination.
SENATOR GALLIVAN:Thank you, Mr. President.
I rise again to support the nomination of Thomas Loughren as a member of the State Commission of Correction. Like Sheriff Beilein, we worked together in our former lives, and Tom Loughren comes tremendously qualified with a tremendous background very well suited for this position.
But I would just point out for all my colleagues, in addition to what you have heard, he served at one time as the president of the State Sheriffs Association and a member of the State Law Enforcement Accreditation Council.
And he's a true criminal justice professional, well suited to meet the challenges of the Commission of Correction. I'll be voting in the affirmative.
ACTING PRESIDENT VALESKY:Thank you, Senator Gallivan.
Senator Seward on the nomination.
SENATOR SEWARD:Thank you very much, Mr. President.
I too rise in support of Tom Loughren to become a member of the State Commission of Correction. I share a portion of Chenango County with Senator Libous and in that capacity have had the opportunity to personally observe the fine work of Tom as the sheriff of Chenango County.
He did an outstanding job in that role. He's operated a correctional facility. He walks the walk and talks the talk as a lawman. He has a wide breadth of experience in law enforcement, a very practical background. And he will serve the people of the State of New York very, very well as member of the State Commission of Corrections.
So I congratulate you, Tom, and I congratulate the Governor on making an outstanding nomination. I'm very pleased to rise in support.
ACTING PRESIDENT VALESKY:Thank you, Senator Seward.
Senator Farley on the nomination.
SENATOR FARLEY:Yes, I rise in support of this nomination. You know, for anybody in this chamber, if you look at this man's resume and how fortunate we are to get somebody to serve in a position with the background that he has, particularly in law enforcement, in homeland security and so many things.
I also on a personal basis chatted with him at good length in the waiting room before he went in for confirmation, and he's a person of integrity and somebody that truly we're very fortunate to have serve as commissioner.
I rise and enthusiastically second this nomination.
ACTING PRESIDENT VALESKY:Thank you, Senator Farley.
The question is on the appointment of Thomas J. Loughren, of McDonough, as a member of the State Commission of Correction. All in favor signify by saying aye.
(Response of "Aye.")
ACTING PRESIDENT VALESKY:Opposed, nay.
(No response.)
ACTING PRESIDENT VALESKY:Thomas J. Loughren is hereby confirmed as a member of the State Commission of Correction.
He joins us today in the gallery.
Congratulations, Mr. Loughren.
(Standing ovation.)

SENATOR CARLUCCI:Thank you, Mr. President.
On behalf of Senator Savino, on page number 49 I offer the following amendments to Calendar Number 1154, Senate Print Number 3677, and ask that the said bill retain its place on the Third Reading Calendar.
ACTING PRESIDENT VALESKY:The amendments are received. The bill will retain its place on the Third Reading Calendar.
SENATOR LIBOUS:Mr. President, give us a second.
(Pause.)
SENATOR LIBOUS:Mr. President.
ACTING PRESIDENT VALESKY:Senator Libous.
SENATOR LIBOUS:The Senate is going to stand at ease because we are waiting on amendments that have to be in tonight. I won't get into the technical reason why, but we have to.
Members will be allowed to leave. And when we do adjourn, we will adjourn until Tuesday, June 18th, at 11:30 a.m. For those of you who aren't sure what I just said, that's tomorrow at 11:30 a.m.
