NEW YORK STATE SENATE
THE STENOGRAPHIC RECORD
ALBANY, NEW YORK
June 11, 2013
11:52 a.m.
REGULAR SESSION
SENATOR DAVID J. VALESKY, Acting President
FRANCIS W. PATIENCE, Secretary
P R O C E E D I N G SACTING PRESIDENT VALESKY:The Senate will come to order.
I ask everyone present to please rise and repeat with me the Pledge of Allegiance.
(Whereupon, the assemblage recited the Pledge of Allegiance to the Flag.)
ACTING PRESIDENT VALESKY:With us today to offer our invocation is Pastor Eli Clement, of the Bruderhof Community in Albany.
PASTOR CLEMENT:Thank you.
So it's an honor to be here. We thank Senator Tkaczyk for the warm welcome and for all her work on behalf of the constituents that she cares for so well.
So let us pray.
Lord, we thank Thee today for another chance to serve Thee and the State of New York. Before Thee, we are like children who know not how to carry out our duties. Therefore we ask, like King Solomon, not for a long life, not for wealth for ourselves, not for the death of our enemies, but that Thou givest us discerning hearts to administer justice and to distinguish between right and wrong.
Let us heed the word of Apostle John: If we love one another, God dwelleth in us and His love is perfected in us. Let us hope that this spirit becomes the order of the day right here in Albany.
We pray for our Governor, the leadership in the New York Senate and Assembly, all our brothers and sisters in the Senate and Assembly, and for our servicemen and women and their families. We pray for our beloved state and nation. May both always be under the sovereignty of God.
In the name of Jesus, amen.
SENATOR LIBOUS:Mr. President.
ACTING PRESIDENT VALESKY:Senator Libous.
SENATOR LIBOUS:Would you please call on Senator Tkaczyk right now.
ACTING PRESIDENT VALESKY:Senator Tkaczyk.
SENATOR TKACZYK:Thank you, Mr. President.
I'd like to rise and welcome Pastor Eli Clement and Johann Huelett, who are here from the Bruderhof Community. And I would like the Senate to know that there are a significant number of members of the Bruderhof Community throughout my Senate district and even in the Capital Region, including right here in Albany.
And just south of Kingston, the Bruderhof bought and restored a magnificent seminary, Mount St. Alphonsus. It was once a seminary for the Redemptist Order, built in 1904. This magnificent facility overlooking the Hudson River could have fallen into disrepair, but the Bruderhof renovated it and turned it into a beautiful high school.
I was fortunate enough to attend their very first graduation ceremony at what's now called the Mount Academy High School this past weekend, and it was a beautiful and extraordinary event for their entire community.
I just would like to encourage my fellow Senators to join me in welcoming the Bruderhof Community to our chambers today, and to thank you for being here with us.
ACTING PRESIDENT VALESKY:Thank you, Senator Tkaczyk.
We welcome the members of the community who are joining us here today in Albany.

SENATOR LIBOUS:Thank you, Mr. President.
Could we now take up Resolution 2293, by Senator Little. We will read the title only and then call on Senator Little to speak.
ACTING PRESIDENT VALESKY:The Secretary will read.
THE SECRETARY:Legislative Resolution Number 2293, by Senator Little, memorializing Governor Andrew M. Cuomo to proclaim June 10-16, 2013, as Museum Week in the State of New York.
ACTING PRESIDENT VALESKY:Senator Little on the resolution.
SENATOR LITTLE:Thank you very much, Mr. President.
Once again, this will be our second year in memorializing a week for New York State Museum Week. And the purpose of doing so is to make everyone in New York State more aware of the huge number of museums that we have to celebrate the diversity and richness of the museums in our state and to encourage people to visit one of the museums in their locality.
Frequently people in their own community have not visited the museum that's right in their backyard, practically. And what we're asking people to do and encouraging them to do is to visit your museum.
There are over 200 museums participating in Museum Week this week. They're having special events, activities, and promotions to give guests a sample of the exhibitions and programs available.
Museum Week 2013 is being cosponsored by the New York State Council of the Arts and Museumwise/the Museum Association of New York and the I Love New York program. There are links on the I Love New York website to all of the museums in New York State and the events that are taking place.
So whether it's in New York City, the Metropolitan Museum of Art or many of the huge museums that they have in that city, to the Hyde Museum in my own hometown of Glens Falls, which this week, in celebration of Museum Week, opens the exhibit entitled "Modern Nature: Georgia O'Keeffe and Lake George." Georgia O'Keeffe lived and summered on Lake George for over 20 years. And this exhibition, which is going to be at the Hyde Museum from June 15th to September 15th, is going to then be a traveling museum that will travel to New Mexico, where Georgia O'Keeffe lived later on.
But it's an outstanding exhibit, and I would encourage you all -- it's kind of right in your own backyard, at least it's here in New York State -- to see it before it travels to other states.
The Empire State Aerosciences Museum will be hosting open cockpit tours, military aircraft, giving people an opportunity to sit in a historic jet fighter or a helicopter. And that's just an example of what our museums are offering.
Many of our smaller museums do not have the financial ability to advertise and to promote themselves, so hopefully this week will do so.
The week is also done in collaboration with the Governor's Path Through History, which took place the last two weeks, highlighting the historically and culturally significant sites and events throughout New York State. And we know that many of those sites are museums.
Museums are not only important for their vital cultural resources for our state, but they're important economic engines for the communities where they exist. They play an education, tourism, and community development role for our cities, towns and villages throughout this great Empire State.
There are abilities, I know, to pass out blast emails, but mostly to just encourage people in your district: Visit a museum and see what wonderful things they have to offer.
Thank you very much, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Little.
The question is on the resolution. All in favor signify by saying aye.
(Response of "Aye.")
ACTING PRESIDENT VALESKY:Opposed, nay.
(No response.)
ACTING PRESIDENT VALESKY:The resolution is adopted.
Senator Libous.
SENATOR LIBOUS:Mr. President, we passed Resolution Calendar Number 2210. And if you could take a moment to call on Senator Gipson, he'd like to make some remarks on it.
ACTING PRESIDENT VALESKY:Senator Gipson on Resolution 2210.
SENATOR GIPSON:Thank you, Mr. President, for this opportunity to speak on Elder Abuse Awareness Day, which will be this coming Saturday, June 15th.
I would encourage everyone in New York State to stop for a moment and think about how we can better assist our communities in helping prevent elder abuse. As the cost of living in New York State continues to rise and we continue to have issues with unemployment, issues are created within our families that unfortunately lead to domestic abuse. Many, many of these cases are not reported.
There are many elders in our communities that are suffering from a great deal of abuse that goes unrecognized and goes hidden. And we need to do more to make the public aware of this. This is an issue that there are many organizations trying to rally around and help our local seniors and elders deal with this unfortunate circumstance.
I encourage everyone, if you know someone who you think may be in danger of being abused and who is a senior, please reach out to the local authorities. There is assistance available. And I would encourage my colleagues here to continue to fight against this in any legislative way that we can.
Taking care of our seniors is critically important. When we lose our seniors, we lose a valuable part of our communities, and we should do everything we can to protect them.
Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Gipson.
Senator Libous.
SENATOR LIBOUS:Thank you, Mr. President.
While we're still on motions, Senator Little would like her resolution opened up to members. And you know what that drill is about, so if you want to share that with the members.
ACTING PRESIDENT VALESKY:The Museum Week resolution sponsored by Senator Little is open for cosponsorship. Anyone wishing not to cosponsor should notify the desk.
SENATOR LIBOUS:Thank you, Mr. President.
Senate Resolution 2125 was also on the calendar. And I believe Senator Hassell-Thompson would like to make some brief remarks.
ACTING PRESIDENT VALESKY:Senator Hassell-Thompson on Resolution 2125, previously adopted.
SENATOR HASSELL-THOMPSON:Thank you, Mr. President. And to the leader, I thank you.
This resolution that has been put forth is about a very young man, Eric Christian, who was in his sixth tour of duty in Afghanistan and who lost his life several weeks ago.
He actually lives in Senator Bonacic's district, but as a young child he lived in our community and my daughter used to babysit him and his brothers. And there are four of them, and they were magnificent boys. Just as boys will do, they did everything. They did it all. And Eric of course was the one who was the ringleader.
Well, he did the same thing in Afghanistan. And he was always ahead of his time, ahead of himself, and an extraordinary young child.
And I got a call several weeks ago that he had been killed in Afghanistan. And I had lost track of him and his family because they had moved away. We knew that they moved to upstate New York, but we had lost the contact. And it was unfortunate that it took this incident for us to reconnect with that family, but it is what life does. It's what life allows, is for us to somehow, in separation, come back together with people who mean a lot in our lives.
And so I thank all of you for signing onto this and for supporting and giving to this mother and father some recognition by this state body that their son was important to someone other than to them. And certainly what he did for his country and for his community shall never be forgotten.
Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Hassell-Thompson.
Senator Bonacic on Resolution 2125.
SENATOR BONACIC:Thank you, Mr. President.
I want to thank Senator Hassell-Thompson in speaking about this hero who is now gone. I had spoken about this young man late in May when he passed away on May 4th. At the Memorial Day parades in Warwick, we talked about his great sacrifice. And his mother lives in Warwick, in Orange County.
And I know, Ruth, you know the family well. And I asked you to carry this resolution because of your personal relationship with this family.
We can't say enough about this hero and all the heroes that have sacrificed their lives for our freedom. And I will assure you, Senator Hassell-Thompson, that he will never, never be forgotten.
Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Bonacic.
Senator Libous.
SENATOR LIBOUS:Mr. President, I think if the chamber could have the doors closed and we just stand and have a moment of silence, please.
ACTING PRESIDENT VALESKY:I ask the sergeants to close the entrances to the Senate chamber.
We ask all Senators and visitors to rise and offer a moment of silence out of respect for our fallen comrade.
(Whereupon, the assemblage respected a moment of silence.)
SENATOR LIBOUS:Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Thank you, Senator Libous.
SENATOR LIBOUS:Senator Hassell-Thompson, can we open the resolution to all the members of the chamber, please?
SENATOR HASSELL-THOMPSON:I'd be very pleased if you did. Thank you.
SENATOR LIBOUS:Let's open the resolution to all the members. And if someone wishes not to be on it, to let the desk know.
ACTING PRESIDENT VALESKY:The resolution is open for cosponsorship.

ACTING PRESIDENT VALESKY:Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you, Mr. President.
I find myself voting no because this bill would actually set up a No Lemon Law for animals, and it would be a new mandate of new regulations on businesses, which yesterday I heard we were opposed to in this house.
So we would be creating a new set of requirements on small businesses and setting up a situation where animals could be returned and then perhaps euthanized by the original salespeople. And the last thing I would want to do is vote for a bill that would increase euthenization of animals that hopefully are being sold or adopted into families.
So I understand the purpose of the bill, but I don't think it really gets us where we want to go. I'll vote no.
Thank you, Mr. President.

(The Secretary called the roll.)
ACTING PRESIDENT VALESKY:Senator Hoylman to explain his vote.
SENATOR HOYLMAN:Thank you, Mr. President.
I wanted to thank Senator Flanagan for his leadership on making this bill a reality.
You know, Mr. President, it's been three years since this chamber passed the Dignity for All Students Act with great fanfare and acclaim, and I think that was deserved.
But I am concerned, Mr. President, that we are extending the Department of Education's grace period another six months before they have to enact training programs for educators. And I do have concerns about it. But again, I'm grateful for the Senator's efforts.
I did want to point out that hate crimes in New York City have increased by upwards of 70 percent since this time last year. And in my district alone, Mr. President, there are have been nine incidents of anti-LGBT violence, including one murder. So, Mr. President, we have our work cut out for us.
And I'm happy that the Dignity for All Students Act is going to be enacted fully hopefully within six months.
Thank you very much, sir.

ACTING PRESIDENT VALESKY:Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you, Mr. President.
Well, I recognize that substituted cathinone is a serious health risk and that something we are referring to as synthetic cannabinoid can also be a dangerous set of chemicals. In fact, the Department of Health describes it as a moving target as to what drugs are being defined on the street in these two categories.
I actually object to synthetic cannabinoid being defined as a type of marijuana. These kinds of drugs actually do appear to be more dangerous. And they attempt to perhaps replicate a certain kind of psychoactive constituent of marijuana.
But actually I believe this state made the right decision in decreasing the penalties for drug use. This bill reverses that pattern by increasing felony penalties for the use of these drugs.
And frankly, we should not be defining other drugs -- synthetic cannabinoids -- under the category of law that applies to marijuana in this state, because I at least am still in the hope we might as a chamber or as both houses move in a positive direction on marijuana policy this year.
I'll be voting no. Thank you, Mr. President.
ACTING PRESIDENT VALESKY:Senator Krueger in the negative.
Senator Hassell-Thompson to explain her vote.
SENATOR HASSELL-THOMPSON:Thank you, Mr. President.
There is mounting evidence that the side effects of synthetic cannabis are substantially more dangerous than naturally grown marijuana. Brand names like Spice and K2 were and are widely used around the world as well as here in the United States.
As the use of this drug increased, there have been mounting medical reports that that drug causes damage to kidneys, causes paranoia, induces high blood pressure, and causes stroke.
As the sponsor indicates, several states have taken action to penalize the possession and sale of synthetic cannabis. And while I agree with the sponsor that possession and sale of this drug should be penalized in New York State, I'm not sure that the sale of any amount of synthetic cannabis should be classified as a C felony.
I do not believe that there is sufficient evidence at this time to justify making the sale of small amounts of synthetic cannabis a felony. And I note that the memorandum in support lists some of the side effects. But additionally, it is not clear to me how the bill concluded that the possession of one quarter of an ounce of synthetic cannabis can be a D and that over an ounce of synthetic cannabis should be a C felony.
Current law around marijuana possession in excess of 16 ounces but less than 10 pounds is a Class D felony and is punishable by no more than seven years of imprisonment. Possession of marijuana in excess of 10 pounds is a Class C felony and is punishable by no more than 15 years of imprisonment.
I submit that a more critical study of the side effects of synthetic cannabis is needed before a citizen can be exposed to up to 15 years in prison for possession of an ounce of synthetic marijuana, up to 15 years in prison for the sale of one stick of synthetic marijuana.
Therefore, Mr. President, I shall be voting no.
ACTING PRESIDENT VALESKY:Senator Hassell-Thompson in the negative.

ACTING PRESIDENT VALESKY:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT VALESKY:Senator Nozzolio to explain his vote.
SENATOR NOZZOLIO:Thank you, Mr. President.
Mr. President and my colleagues, if you can imagine the horror of losing, on one single afternoon, your daughter and your granddaughter. That's exactly what happened to Dale Driscoll, who, because of a violent perpetrator entering into the home, lost her daughter and her granddaughter Brittany, for whom this law is named.
Brittany's Law establishes a registry of those who have been convicted of violent crime. A protection, if you will, of those who are going out and meeting people, knowing people, bringing them into their business, their community or their home.
I believe this law will help stem the tide of rising threats of domestic violence, will help again send a signal that this New York State is establishing a zero tolerance for violence at all levels. And that it is certainly a tribute and a memory of a young lady who was helpless and defenseless against a heinous act of violence.
Mr. President, it's a very good bill. Thank you for the opportunity to speak on it. And it has my full support. Thank you.
ACTING PRESIDENT VALESKY:Senator Nozzolio in the affirmative.
Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you, Mr. President. I appreciate the Senator's passion for his bill.
My concern is the bill talks about being a registry for individuals convicted of domestic violence offenses, but in fact it would be anyone who goes to jail on any category of violent felony offense under Section 70.02 of the Penal Law. That's approximately 35,000 people in our prison system currently, 35,000. And since they get out most of the time, if this became the law we would have the equivalent of a sex registry system for easily 100,000 people within a few years.
There's no cost analysis of this bill, but we know it will cost the state a huge amount of money. And I think though the goal is sincere, the legislation is far too broad in its impact and that this state should not move forward at this time.
I'll be voting no. Thank you, Mr. President.

ACTING PRESIDENT VALESKY:Senator Gipson to explain his vote.
SENATOR GIPSON:Thank you, Mr. President.
This is another example of a one-house bill that, rightly so, addresses the need to make sure that sexual offenders are kept out of our public places. But my concern is that we are not in this house doing enough to help the victims of sexual violence.
Right now throughout this state there are many, many people that are being subjected to sexual violence, many of them children. In my district recently, last year, a little girl, a very little girl was raped over and over and over again by her father. If you can imagine how traumatic that experience must be -- to be able to do anything to speak up on behalf of what happened to her and all the other people that are subjected to crimes like this is incredibly difficult.
And it's why we have so many sexual offenders that are unknown that continue to roam around in society. And we are not convicting them because we are not giving the victims a way to testify against those who have committed these awful, awful crimes.
But I have a bill that would change that and would once and for all make sure that we not only convict these horrible people but we keep them behind bars. And it's a bill that has a sponsor in the Assembly. It's called Rosie's Law.
And in my case, in my district, this little girl was able to go testify against her father because she had the assistance of a courthouse facility dog that's specially trained to help these victims testify in really stressful circumstances.
Her father was sent to prison for a very long time, but he's now possibly going to get out because the law itself does not state that these dogs are allowed. Rosie's Law changes that and says that these facility dogs are allowed.
SENATOR LIBOUS:Mr. President, is Senator Gipson speaking on this bill or is he speaking about one of his bills that's not before us?
SENATOR GIPSON:Mr. President, it's my understanding that explaining my vote, it does not have to be germane to the subject.
ACTING PRESIDENT VALESKY:Actually it does, Senator Gipson. We are on Calendar Number 995, the Senator Lanza bill. How do you vote on Senator Lanza's bill?
SENATOR GIPSON:I'm going to be supporting Senator Lanza's bill, and I hope that the --

You know the old adage "If it's not broke, don't fix it"? Well, our Parole Board system is working. And if we require, as this bill does, that there is unanimous agreement by all members of a Parole Board before someone can be released, we will be increasing the number of people who stay in prison for longer periods of time without justification, increasing the cost to the State of New York.

I will get right to the point. This bill will cost my district enormous amounts of money.
I primarily have part-time building inspectors in my district. I suspect this is the case throughout many parts of the state. They will have to somehow find a way to all of a sudden start inspecting all the state buildings in their area, and that will not be paid for by our state government.
This will cost our local governments millions and millions of dollars. It is undoubtedly a huge unfunded mandate, and I cannot support it. And I will be voting no.

ACTING PRESIDENT VALESKY:Senator Grisanti to explain his vote.
SENATOR GRISANTI:Thank you, Mr. President.
My fellow colleagues, I'm not sure how many of you know what a central service professional or a central service person is and what work they perform. I'm not going to ask for a show of hands. But basically they're ensuring that the instrumentation and equipment used in medical procedures, especially in surgeries, is cleaned, disinfected, inspected and sterilized, so this way you don't get sick after the performance of a procedure.
So this legislation requires certification of these technicians, which will ensure that they have the ongoing education and requisite knowledge to make sure that this is being done. And it includes robotic equipment just as well.
It passed both houses last year and was vetoed by the Governor. A tireless effort has been done by Assemblyman Bronson and his staff, my staff. Senator Savino, Senator Hannon, and Senator LaValle, I also want to give you a shout-out with regard to this bill.
It had no opposition as of the changes that were made. And unfortunately the central service profession is one of those that we value and contributions continue to be underestimated and overlooked by healthcare organizations and others across the nation.
So by doing what we're doing here in New York, we're protecting patients that are in care with regard to these individuals that have to make sure that this equipment is cleaned and sterilized and inspected properly to continue your health after surgery.
I vote aye, Mr. President. Thank you very much, my colleagues.

ACTING PRESIDENT VALESKY:Senator Grisanti to explain his vote.
SENATOR GRISANTI:Yes. Again, thank you, Mr. President.
Fellow colleagues, the Buffalo School District, as we know, is a dependent school district, dependent on the State of New York for its money. And as such, I feel that our residents of the City of Buffalo should get a chance to vote on how the school district and the school budget is allocated. And they don't have that opportunity, unlike most school districts who can vote on their budget.
And the District Parenting Council that's in Buffalo contends that through their research, that districts voting on their school budget, they have higher graduation rates with fewer persistently low-achieving schools and fewer schools under review.
This legislation seeks to make the district more accountable to a community that has a budget of over $800 million. That's the City of Buffalo School District budget, $800 million, and the people of Buffalo don't get to vote on it.
So with graduation rates in the Buffalo school system at 50 percent, at 31 percent for African-Americans, and for Hispanics at 31 percent, spending over $27,000 per student, it's a disgrace.
So it's vital that we allow our parents to be involved with these type of decisions to move forward with bioinformatics and science technology. These kids are not even given the opportunity to go to a secondary school and further their education, where we have in Buffalo "Say Yes to Education" that will allow them to have free college tuition through a program that's been set up. But they're not going to get there because they're not graduating from high school.
So the struggles of our school district is that's not going to be solved overnight. But I believe this, along with other bills that have been passed, like moving the elections of the school districts from May to November, could help out tremendously. We need greater accountability from our elected members of the Buffalo Board of Education and also their important employees.
And I urge you to vote for this bill; it's important for the students in the City of Buffalo. I vote aye, Mr. President.

(The Secretary called the roll.)
ACTING PRESIDENT VALESKY:Senator DeFrancisco to explain his vote.
SENATOR DeFRANCISCO: Yes, this is an excellent bill. That's why it passes the Senate every year.
Those who have influence in the Assembly, if they would like to help their constituents save money when they refinance the mortgage, it would be wonderful if they would pass this bill.
And basically what it does, if I have a $20,000 mortgage on my house, I want to refinance it and get $20,000 new money -- let's say $30,000 new money -- if I could get an assignment of the mortgage from the first mortgage and we consolidate the loan with a second bank for the additional 30 grand, I only have to pay mortgage tax on the 30,000, the additional new money, rather than repay a mortgage tax on a mortgage that was previously existing.
So it saves mortgage tax money, and I would hope that we could get it passed in the Assembly this year. Thank you.

THE SECRETARY:Legislative Resolution Number 3222, by Senator Klein, honoring Danny Hay in recognition of his prompt and heroic efforts to rescue three people on New York City subway tracks from an oncoming train.
"WHEREAS, It is the sense of this Legislative Body to recognize and commend the concerned and heroic acts of those citizens who would voluntarily take immediate and appropriate action to protect the health and safety of others; and
"WHEREAS, At 8:30 a.m. on Sunday, April 7, 2013, MTA train operator Danny Hay of New York City was at the Delancey Street subway station on his way to work when he observed an unconscious man lying on the subway tracks; and
"WHEREAS, Responding without hesitation or concern for his own welfare and safety, Danny Hay immediately sought to render assistance by calling for the power to the tracks to be cut off; with the power still on, he returned to the tracks and found two Good Samaritans along with the unconscious man still on the tracks in the path of an oncoming F train; and
"WHEREAS, In response to this life-threatening emergency, Danny Hay ran to the end of the Delancey Street subway station and flashed his flashlight to the operator of the oncoming F train; the operator of the train was able to successfully stop the train in the nick of time; and
"WHEREAS, For his courage and decisive action, taken without due regard for his own personal safety, Danny Hay has aptly demonstrated his character and compassion for the welfare of others, personifying, by virtue of his action, the collective concern of ordinary citizens across the community --
ACTING PRESIDENT VALESKY:Senator Libous.

THE SECRETARY:And "WHEREAS, For his courage and decisive action, taken without due regard for his own personal safety, Danny Hay has aptly demonstrated his character and compassion for the welfare of others, personifying, by virtue of his action, the collective concern of ordinary citizens across the community of New York State who voluntarily respond without thought of danger or reward when others are in need of help; and
"WHEREAS, It is the sense of this Legislative Body to recognize, honor and pay tribute to those individuals within the State of New York who perform rescue operations with courage, diligence and precision, resulting in heroic life-saving actions; now, therefore, be it
"RESOLVED, That this Legislative Body pause in its deliberations to honor Danny Hay of New York City in recognition of his prompt and heroic efforts to rescue three people on New York City subway tracks from an oncoming train; and be it further
"RESOLVED, That a copy of this resolution, suitably engrossed, be transmitted to Danny Hay."
ACTING PRESIDENT VALESKY:Senator Klein on the resolution.
SENATOR KLEIN:Thank you very much, Mr. President.
I'm deeply honored today to present this resolution to New York's very own Danny Hay.
Each and every day, as you know, public sector workers keep our state -- in this case, our city -- running. Danny, as a dedicated employee of the MTA for years now, has kept millions of New Yorkers moving each day.
But I think it's incumbent upon all of us here today to recognize him not only for what he does each and every day as far as his sacrifice and service, but his heroic act of bravery in saving three people from a speeding train.
It was that day when Danny was going to work down on Delancey Street, and basically saw what was going on and single-handedly, by using grit and courage, forced the train to slow down and not hit three individuals who were on the track. One took ill, two other Good Samaritans went to help him, and Danny wound up saving each and every one of them.
He single-handedly stopped the speeding train from hitting these people, and I think we owe him really a debt of gratitude. Each and every day he serves us, but on this very special day I'm proud to call Danny a hero.
So with that, I hope everyone will join us in recognizing Danny, because I think Danny Hay is an inspirational service to each and every one of us.
Thank you, Danny.
(Standing ovation.)
ACTING PRESIDENT VALESKY:We want to welcome Mr. Hay to Albany today and certainly thank you, sir, for your heroic efforts.
