ACTING PRESIDENT GRIFFO:Senator DeFrancisco.
SENATOR DeFRANCISCO: Thank you.
In view of the time in this legislative session, with so much going on, I haven't asked for the resolution to be read. But this is a very important resolution, and we have guests in the room concerning this.
Yesterday we passed this resolution which basically calls on the Governor to declare July 19th to 25th of this year as Arteriovenous Malformation Awareness Week in New York State. It's sometimes known as AVM.
And AVM is defined as an abnormal connection between arteries and veins which bypass the capillary system. AVM is a rare condition that affects approximately 300,000 Americans. And one such American is here today, Kelleigh Gustafson, with her parents and her physician, Dr. Eric DeShaies.
It's a very difficult condition. She's had it since she was 4 years old. Could you just stand, Kelleigh? Absolutely beautiful woman that goes through very difficult times because of this condition.
And she started an organization called Kelleigh's Cause when they lived in Michigan. Now they live in Central New York, and I'm very proud of that. And she wants people to at least know about this disease and start spreading the word so that there can be more research about the disease.
Kelleigh's Cause was founded in Michigan, as I mentioned, since she was diagnosed with this when she was 4 years old. What it does is it affected her right side of her head, neck and chest at 4 years old.
And people should know about this disease in order so that we can get rid of it. The problem is there's so few inflicted with it, there's not that big cause out there.
Well, this is going to be a big cause with Kelleigh. She's dedicated to it, she is clearly motivated to make people know about the disease so we can help her and many others like her.
So first of all, I want to congratulate her, her parents and her physician, who are here today. And I want to make sure that everybody spreads the word in their communities.
And I would ask that this resolution be open to any other Senator throughout the state who would like to support this cause. And if you do not want to be on, you should notify the desk.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Thank you, Senator DeFrancisco.
The resolution was adopted yesterday, on 6/9/15. The resolution is open for cosponsorship. Should you choose not to be a cosponsor, notify the desk.
I would like to extend a warm welcome on behalf of the New York State Senate to you and your guests. We appreciate all you're doing, and we extend the best wishes of the Senate. Let us all rise and give this young lady and her family our recognition.
(Standing ovation.)

THE SECRETARY:Section 3. This act shall take effect immediately.
ACTING PRESIDENT GRIFFO:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT GRIFFO:Senator Rivera to explain his vote.
SENATOR RIVERA:Thank you, Mr. President. I just want to briefly explain my vote.
This bill, there's many of us that are particularly in the City of New York that will be voting against it, because the concept here is that 10 percent, as the bill states -- it provides that the New York City Health and Hospitals Corporation would spend a minimum of 10 percent of its budget on acute care and emergency room facilities in each borough.
There are five boroughs in the City of New York. It establishes that 10 percent would be used for each borough. Unfortunately, the reality is that the population of the city is not equally divided amongst the five boroughs. And therefore the need, the medical need of each one of the populations that go to public hospitals of the Health and Hospital Corporation are not equally divided amongst the five boroughs.
So while I certainly would welcome any conversation with Senator Lanza about resources of the Health and Hospital Corporation to go to Staten Island that might not be available right now, unfortunately what this bill does is it literally takes away resources from where most of the population is, which is not in Staten Island.
So for that reason, I will be voting in the negative.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Senator Savino.
SENATOR SAVINO:Thank you, Mr. President.
I rise in support of this piece of legislation. Obviously I'm a Staten Islander, so I have a vested interest in this.
But I would like to point out to my colleagues from the City that are voting against it that Staten Islanders right now represent 500,000 people. And I want you to keep this in mind. Twenty years ago, the population of Staten Island was half of what it is now, and at the time we had five hospitals. Five hospitals for less than half of the number of the population. None of them public hospitals.
The fact is Staten Islanders contribute every day to the tax coffers of the City of New York, and in exchange we get zero money from the HHC. So the people of Staten Island do not receive any services at all in any way, shape or form from the Health and Hospitals Corporation, and the argument for that is because we don't have a brick and mortar institution on Staten Island.
While that may be true, 20 years ago, five hospitals. Right now, the population has doubled and we have two hospitals, because three of those private nonprofit hospitals have gone under in the interim time.
We're simply saying to the City of New York that Staten Islanders are part of the fabric of the City of New York. We are New York City residents just like everyone else. And we deserve to be treated by like all of our other neighbors around the City of New York.
And if we can't have a brick and mortar institution in Staten Island -- which probably doesn't make much sense; as we all know, hospitals are expensive to build and maintain -- we should at least be guaranteed a minimum of the services that our constituents are entitled to.
Because we don't have a brick and mortar institution run by the HHC on Staten Island, we don't have a rape crisis center on Staten Island. That is a travesty for women who are assaulted on Staten Island, that they have to leave Staten Island to go and receive treatment.
So we're simply saying to the HHC -- we've tried this conversation with them for years -- if you're not willing to give us what we're entitled to, we're going to push the legislation until someone pays attention.
So I'm happy to hear, Senator Rivera, that you want to have that discussion. As ranker on the Health Committee, I hope that yours is a voice that will, you know, perhaps make some sense to the City of New York.
We are entitled to be treated the same as every other New York City resident with services from the HHC. We don't get it now. That's what this bill is about.
And I would urge my colleagues to think twice before they vote no. Perhaps it is only, you know, a gesture. Maybe the bill doesn't really mean anything. But it matters to the people of Staten Island that we be treated the same as everyone else. After all, the tax man treats us the same way as everyone else.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Senator Savino to be recorded in the affirmative.
Senator Comrie to explain his vote.
SENATOR COMRIE:I appreciate Senator Savino's passion about the need for HHC services in Staten Island, and I understand my esteemed colleague Senator Lanza's desire to make sure that HHC is servicing Staten Island.
But the fact of the matter is that once we start working off percentages and not on population, you're violating the basic things that eliminated the Board of Estimate in New York City. Once you start dealing with percentages as opposed to population, you're creating an imbalance, a fundamental imbalance.
I also want to remind our Senators that, you know, Queens has lost a lot of hospitals in the last five years. We've lost over five hospitals in the borough. And we're looking for HHC to do more in our area. We're all needing more services as our population is expanding. There's an increase all over the city. As the Queens population has exploded, especially in northern and western Queens, there's a need for a HHC hospital there where there is not one now.
As populations are exploding in my district in Jamaica and in eastern Queens, we need an HHC hospital there. The one that we have is overcrowded and needs facilities.
While I understand my esteemed colleagues' need for making sure that that happens, the fact of the matter is that they are getting a building built by HHC in a hospital, where they're spending over $5 million to provide urgent care services to their area. The fact of the matter is that they are getting subsidies for their private hospitals by HHC in the area.
I'm concerned about the population and making sure that the services are handled per population and not just density, not just per borough, which creates a fundamental imbalance that has already been proven by the courts to be unfair. That's why I'm voting against this bill.
I also want to remind folks that as we are working to increase density, as we are working to look at 421a, as we're looking to deal with affordable housing, we must make sure that our hospitals are able to meet those needs of the expanding population that we have also. And that our hospitals now, our HHC hospitals, the two that we have in Queens, Elmhurst and Queens Hospitals, are in need of major upgrades and rehabilitation. And we need to be mindful of that in the budget as well.
So I'm voting no against this not because I'm against the desire of Staten Islanders to have as many medical services as possible, but there's a fundamental imbalance once you start doing percentages based on a borough as opposed to actual population.
I'm voting no. Thank you.
ACTING PRESIDENT GRIFFO:Senator Comrie to be recorded in the negative.
Announce the results.
THE SECRETARY:In relation to Calendar 182, those recorded in the negative are Senators Comrie, Espaillat, Gianaris, Hamilton, Krueger, Latimer, Montgomery, Panepinto, Peralta, Rivera, Sanders, Serrano and Stavisky. Also Senators Dilan and Hassell-Thompson.

THE SECRETARY:Section 7. This act shall take effect on the first of November.
ACTING PRESIDENT GRIFFO:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT GRIFFO:Senator Croci to explain his vote.
SENATOR CROCI:Thank you, Mr. President.
Mr. President, I want to first thank the members of our staff who have worked so hard on this bill.
As you know, we live in a very difficult time. Be it Ted Kaczynski, Timothy McVeigh, Jose Padilla, Omar Abdel-Rahman, Ramzi Yousef, Khalid Sheikh Mohammed, motivations aside, if individuals commit a terrorist act in the State of New York, we need to understand where they are.
The members of the communities have a right to know where they are, and law enforcement needs the tools and the resources to identify them. The federal government has asked for these resources, and I'm proud that we are now in a position to provide an additional piece of information to help them do that.
I urge my colleagues to think about, very carefully, where we are in our history, where we will be next year. I urge your support for the City of New York, for the counties around New York to protect our families, to protect our residents, to protect our property.
And I also urge our colleagues in the Assembly and our Governor to be the first in the United States to propose a terrorist registry to protect New Yorkers.
Thank you. I vote aye.
ACTING PRESIDENT GRIFFO:Senator Croci to be recorded in the affirmative.
Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you, Mr. President.
I appreciate the sponsor's efforts here. We do live in a time where there's fear. There's fear of domestic terrorism, there's fear of international terrorism. We live in the great State of New York that went through 9/11.
And I think we learned a lot from that experience and in the 14 years since, which includes the fact in times of fear and disruption, it's more important than ever that we in the United States hold to our principles of our Constitution and our assurance that every person in this country is innocent until proven guilty and is not assumed to be a criminal prior to evidence of such, including the possibility of wrongly being defined as terrorist.
At one time we believed as many a million people in this country were on FBI watch lists. Surely we didn't think there were a million terrorists in our midst.
And my concern about this bill and the reason I'll be voting no is despite the fact that I believe that the Senator did hear of concern and he amended his bill from the first version, it still leaves people in the situation where having not committed any kind of act or even intent to commit a verifiable act or to have been determined to pose a serious threat of committing a terrorist act and not having been charged with anything or found guilty of anything, they could end up being determined to be a terrorist, told to be on a terrorist registry for the rest of their lives, that they have to renew every three months, told that -- well, actually maybe not told.
Because even if you don't get the notice saying we've determined you could be a terrorist and you have to be on our terrorist registry, you could, for failure to register, something you didn't even know you were supposed to, face 15 to 25 to life imprisonment under Class A-I felony no record considerations law.
You can't set laws that make the presumption that people who live amongst us are criminals and in fact terrorists without strong evidence that that is true.
You can't put people in the situation where we're labeling them for life publicly and they face prison for nothing beyond not knowing they were supposed to register for something they weren't aware they were.
There's too many examples, even from the last 15 years in this country, of why this approach can be very, very dangerous with unintended consequences. I cannot support this bill.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Thank you. Senator Krueger to be recorded in the negative.
Senator Hoylman to explain his vote.
SENATOR HOYLMAN:Thank you, Mr. President.
I too appreciate the sponsor and his team's work on this bill.
I have to oppose it because, with all due respect, I think it's a little naive to think that a terrorist would self-certify for a registry.
The terrorists that the sponsor has mentioned in fact are all in federal prison, so we know exactly where they are.
And I do understand that the example that the sponsor has cited, the Lackawanna Six, involved individuals charged with terrorism who apparently still live in New York State. And I though think it's important to note that these were individuals who were actually under a witness protection program. So the idea that they would self-certify and add their names to a registry doesn't make sense under those circumstances.
This is an issue that is frankly out of our league. We have a responsibility to our constituents at the state level, but this is clearly an issue that the federal government, the National Security Agency, the CIA, the NSA, the U.S. Department of Homeland Security should, in my humble opinion, be providing us guidance on, not the other way around.
So therefore, in addition to the constitutional concerns which were raised, I'll be voting no because it's unworkable at the state level.
Thank you, Mr. President. And thank you again for the sponsor's efforts.
ACTING PRESIDENT GRIFFO:Senator Hoylman to be recorded in the negative.
Senator DeFrancisco to explain his vote.
SENATOR DeFRANCISCO: You know, every once in a while I wonder if I'm hearing correctly, because the world seems to be going on its head.
When we in this state don't -- by the way, all terrorists don't go to jail for life. Some actually get out. So they have a time after that to be on a registry, just like sex offenders.
But what's really contradictory, in my mind, we're concerned about the civil liberties of a person convicted of terrorism but we without even a thought decide to set up a registry for all lawful citizens to record when they obtain ammunition, from whom, without any indication there was any wrongdoing. At a substantial cost, a cost so substantial that we haven't even done it yet. And that's why we passed a bill the other day to eliminate that part of the so-called SAFE Act.
So bad people should be followed. Bad people who have committed bad acts should be followed and registered, just like sex offenders. Law-abiding citizens should not have to be looking over their shoulder as long as they're following the law and doing what good citizens should do.
I vote aye.

SENATOR SERRANO:Thank you very much, Mr. President.
There is a continuing health epidemic in communities across the Bronx. For decades we have seen the incidence of asthma, childhood asthma, increase, and it is having such a devastating effect on the lives of children across the borough. It means school days lost, it means emergency room visits, and it means an overall decrease in quality of life for so many.
When you couple the many other health disparities that people in my community face, whether it be childhood obesity, diabetes, heart disease, the fact that asthma has such a strong grip on such a large part of our community is very troubling.
This bill would create a study to look into, in much deeper ways, the high incidence of asthma in the Borough of the Bronx and, more than that, come up with a remedial plan to help stem this crisis so that children can spend more time in school, more time playing and recreating, and less time dealing with this debilitating disease.
Thank you very much, Mr. President.

SENATOR SAVINO:Thank you, Mr. President.
You know, if I were a spiteful person I would vote against this bill and I would say you voted against my community and their healthcare needs, I'm going to vote against yours.
But I'm not a spiteful person. The people of the Bronx suffer from healthcare disparities, the people of the Bronx have high rates of asthma, we should do everything possible to help the people of the Bronx.
And I hope next time people will think about helping the people of Staten Island.
Thank you, Mr. President.

ACTING PRESIDENT GRIFFO:Senator Carlucci to explain his vote.
SENATOR CARLUCCI:Thank you, Mr. President.
We as lawmakers have to do everything possible to keep our children safe, particularly when we talk about our youngest children. Right now there's a gaping loophole in state law that allows for Level 3 sex offenders, those most likely to reoffend on parole, to live right next door to a registered daycare.
This legislation would prohibit a Level 3 registered sex offender from living a thousand feet within a daycare.
Every day during the week when I'm home in the district, I take my son to daycare and drop him off. And I think like most parents we expect that our kids are in a safe, protected environment.
This is something when you learn that in many cases, which we've seen in my district, where a Level 3 sex offender will move in right next door to a daycare, it's absolutely outrageous. We have an instance in Congers, New York, where a Level 3 sex offender is now living 173 feet from a registered daycare.
I want to thank my colleagues for supporting this bill so we can close that loophole and make sure we're doing everything we can to keep our youngest children as safe as possible.
Thank you, Mr. President.

SENATOR SQUADRON:Thank you, Mr. President.
I have in the past voted for peace officer bills. Certainly there are places where we need to expand it. The time has come to do this in a comprehensive way. The Governor has said so in veto message after veto message.
If we don't do it comprehensively, we should at least have some structure or system in place to assess these things. So unfortunately, I think this year enough is enough. I'm doing this ad hoc.
We had a good discussion on this in conference; I know this is a bipartisan issue. Let's stop just doing peace officers every time it randomly comes up, and let's start doing it based on some kind of measures.
I'll vote no, Mr. President.

SENATOR KRUEGER:Thank you, Mr. President.
I'm voting no on this bill. Interestingly, it's similar to the next bill we will take up involving penalties for violence towards a member of the military.
In the next bill, which I'll be voting yes for, you knew the person to be a member of the military when you attacked them while they were doing their duty.
In this bill, there's nothing about them being on duty in the military or even being in uniform. It's simply if it's determined that they were a member of the military or reserves, then there's a higher penalty for the person committing the crime even though it had nothing to do with their activity, their activity at that time or whether or not they might be in uniform.
So I vote no, Mr. President. Thank you.

ACTING PRESIDENT GRIFFO:Senator Espaillat to explain his vote.
SENATOR ESPAILLAT:Thank you, Mr. President.
This bill addresses a major problem affecting our nation, that of suicide among young people. It is the third leading cause of death among people between the ages of 15 and 24.
An important intervention must take place. This bill calls on the Office of Mental Health and the Department of Education to develop materials for educators regarding suicide prevention and signs of depression among school-age students.
This is important that we continue to push for these measures to ensure that we save our children's lives.
Thank you, Mr. President. I'll be voting in the affirmative.
ACTING PRESIDENT GRIFFO:Senator Espaillat to be recorded in the affirmative.
Senator Hoylman to explain his vote.
SENATOR HOYLMAN:Thank you, Mr. President.
I wanted to thank and commend my colleague Senator Espaillat for this important bill. You know, 20 percent of LGBT kids attempt suicide every year, and it's such an important issue that we address this.
There are other ways we can do it, including banning conversion therapy, passing the Gender Expression Non-Discrimination Act, and other initiatives we can take in this body in addition to the Senator's bill.
But I'm very grateful to him for his efforts and will be voting eye.
ACTING PRESIDENT GRIFFO:Senator Hoylman to be recorded in the affirmative.
Senator Carlucci to explain his vote.
SENATOR CARLUCCI:Thank you, Mr. President.
I want to echo my colleagues and thank Senator Espaillat for championing this legislation.
As Senator Espaillat said, suicide is the second leading cause of death for young people ages 10 to 24. I was reading some statistics that teenagers are more likely to die from suicide than heart disease, cancer, AIDS, birth defects, stroke, pneumonia, influenza and chronic lung disease combined. So it shows that there's a need for this legislation.
And this isn't a mandate. It's simply allowing SED and the Mental Health Department to work together to come up with materials that can complement our school districts, to make sure that of course we're teaching our children all the important things -- reading, writing, math -- but we also need to focus on our brain and making sure that we're noticing signs of depression, noticing those symptoms.
And by doing this, we can change the scope, we can change the direct path that we're on, and we can save lives.
So thank you, Senator Espaillat, and thank you to my colleagues for voting on this important legislation.
ACTING PRESIDENT GRIFFO:Senator Carlucci to be recorded in the affirmative.
The Secretary will announce the results.

So on behalf of my constituents, I want to thank my colleagues for supporting this bill.

SENATOR FUNKE:Thank you, Mr. President.
I rise to encourage my colleagues to vote aye on this important piece of legislation that is going to provide our farmers with grants of up to $50,000 for infrastructure, for equipment, and for practices.
You know, for decades, ladies and gentlemen, the number of farmers across New York State has been shrinking. In 2007, the last agricultural census, there was a 4 percent increase in the number of farms, the first since 1920 -- which is good.
As promotion of locally grown food has been on the rise in recent years, our farmers still struggle to get a foothold in the market. Start-up costs for new farmers are daunting. And even generational farms face enormous costs when needing to upgrade their equipment or their infrastructure. And their success or their failure can be a matter of investment dollars that leads to greater productivity.
And you know, sometimes farmers face an uphill battle raising capital to start a farm or to keep a farm and to keep it viable. The Farm Investment Fund is going to give state grants of up to $50,000 to help farmers invest in their business.
In 2010, agricultural production accounted for almost $5 billion in our state. Almost a quarter of our land area is used to produce agricultural products. The farm industry is important to our state's economic vitality, and this bill will only further the goal of keeping our farmers invested in, staying and operating in our great State of New York.
So I vote aye, Mr. President, and I humbly urge my colleagues to do the same.
Thank you.

SENATOR DeFRANCISCO: When a lawsuit ends in a monetary verdict, and if one party wants to appeal, they have to post a bond in a certain amount depending upon the amount of recovery that was ordered by the jury.
The master settlements in tobacco litigation has resulted in substantial verdicts which many counties and states have monetized by using the flow of the payments to -- to bond the -- to monetize the payments that would be periodic to get a lump-sum dollar amount. Also, many states and counties get payments on a periodic basis based upon what they won in the settlement, or what they agreed on in the settlement.
If a major lawsuit anywhere in the country, but especially now in New York, resulted in a huge verdict, and the defendant tobacco company had to post a bond, it could bankrupt the tobacco company and jeopardize payments made all over the country on this master settlement.
For example, there was a lawsuit in Florida that resulted in an award of $145 billion in punitive damages. To post a bond in that amount would have cost $14 billion, which would jeopardize the ability of that company to pay all the settlement amounts that they were required to pay.
So what most states, just about every state has done to avoid that happening and continue the cash flow from the tobacco company while the appeal is going forward, they have set a limit on what the amount of the bond has to be. Some states have $100 million bonds and so forth.
What this bill does is to make a maximum bond that a defendant would have to post on an appeal, to $250 million.
By the way, in that Florida case, the State of Florida had a bond limit, the case went up on appeal, and the punitive damage part of the appeal was eliminated. So it turned out that the company never had to pay any of that punitive damage amount. So if they didn't have that bond limit, the company would have ended up going bankrupt when the appeal was pending.
So it's a prudent thing to do to have a bond limit. We don't. And that's why we thought it would be a good idea. And we've thought many years that we would do this. It hasn't happened yet. So we're trying it again this year.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would please yield.
SENATOR DeFRANCISCO: Yes.
ACTING PRESIDENT GRIFFO:The sponsor yields.
SENATOR KRUEGER:I thank the sponsor for his explanation.
And as he pointed out, this bill has been floating around for many years and we've been under our master settlement for many years.
Is there any current lawsuit in New York State expected to result in a multi-billion-dollar settlement against tobacco companies, causing possible bankruptcy?
SENATOR DeFRANCISCO: I know of none at this point in time.
However, if one arises, I think it would be more prudent to pass it now so we have this protection, rather than be called to special session on Christmas Day in order to pass a bill that would provide the protection we would need under these circumstances, when 39 other states already have done so.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:Is the sponsor aware that despite the fact that the master settlement was made -- ooh, now I have to find the date -- quite a few years ago, and that it is well-documented that tobacco companies lied to the public, lied to government, continue to be in the business of in fact killing their clients as part of their business model, is the sponsor aware of how the tobacco companies' profits are doing?
SENATOR DeFRANCISCO: Well, I'm not aware of that. However, for any tobacco company to be required to post -- pay $14 million for a bond that would jeopardize the payment -- their viability as a company, that would jeopardize the payment that all of the counties in the state are relying on, and jeopardize the payments of settlements that affect other states, I don't think that is a good policy to get involved with.
And the rhetoric about killing people, I don't think too many people have been forced to put a cigarette in their mouth. At least not that I know of.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
ACTING PRESIDENT GRIFFO:The sponsor yields.
SENATOR KRUEGER:Thank you.
Whether they're forcing them to put a cigarette in their mouth, the fact is their business model is to encourage people to smoke, sell their product, see them die, and then encourage more people to smoke so they can continue their business model.
But a question for the sponsor. Even if one accepts the argument that New York State is protecting itself from bankruptcy of tobacco companies in order to ensure we continue to get our master settlement payments, would the sponsor continue some alternatives, such as the courts granting the authority to reduce the amount of an appeal bond below the monetary judgment amount but only to an extent necessary? So once we have a bankruptcy scenario, could we not have a law that required the court to adjust what that appeal-bond monetary number might be, based on the realities of a specific court case and a specific company?
SENATOR DeFRANCISCO: Well, first of all, I'm really shocked at the Senator's hypocrisy in saying that tobacco companies are trying to force people to smoke, when just last night you tried to force me to smoke a marijuana cigarette.
(Laughter.)
SENATOR DeFRANCISCO: And it shocks me. It shocks me. We maybe --
(Cross-talk; laughter.)
SENATOR DeFRANCISCO: All right. In all seriousness, that is obviously an alternative that could make sense.
But here, the Legislature is setting the limit, rather than a judge having the power to arbitrarily make a decision.
ACTING PRESIDENT GRIFFO:Perhaps you should have both finished that spaghetti last night.
(Laughter.)
SENATOR KRUEGER:Through you, Mr. President --
ACTING PRESIDENT GRIFFO:Senator Krueger.
SENATOR KRUEGER:-- if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:Would the sponsor please confirm or deny that what I was trying to get him to smoke last night was oregano, not marijuana?
(Laughter.)
SENATOR DeFRANCISCO: I have no idea.
(Laughter.)
SENATOR DeFRANCISCO: Because the questioner just tried to get me to smoke something.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
ACTING PRESIDENT GRIFFO:The sponsor yields.
SENATOR KRUEGER:Thank you.
Could the state not institute a formal appeal cap based on a percentage of the defendant's total assets or average net revenues over the past several years, rather than a flat, relatively low $250 million bond, considering tobacco company profits I believe are up to $91 billion this year, based on something I just looked up?
SENATOR DeFRANCISCO: Yes, we could. But this bill does not do that.
SENATOR KRUEGER:On the bill, Mr. President.
ACTING PRESIDENT GRIFFO:Senator Krueger on the bill.
SENATOR KRUEGER:Thank you.
I partially thank the sponsor for some of his answers.
I will again go on record, tobacco is well-documented to in fact cause a large number of illnesses leading to death at disproportionately high levels. And in fact the business model of tobacco companies is in fact to encourage the smoking of tobacco and other uses of tobacco that result in incredibly high healthcare costs nationally and a disproportionately large death rate directly correlated to their products.
Nonetheless, interestingly, because of the master settlement, the State of New York does have a fiscal incentive to make sure tobacco companies don't go out of business. Because if they go out of business, we don't get paid our settlement costs. And to some degree the sponsor's bill is an attempt to protect the State of New York from losing revenue on a master settlement by helping ensure tobacco companies don't go out of business.
I personally don't think the State of New York should be in the business of helping tobacco companies stay in business or continue to sell their products. But I do recognize we want to make sure that we don't get left without our fair share of the master settlement payments.
And so I did propose two alternatives that had been recommended that I believe would be a more fair and correct approach to protecting ourselves from the possibility that a company might face bankruptcy if they were to lose a large enough case in court.
In real-world terms, Mr. President, I would hope that they do get put out of business, that there are enough lawsuits that finally get tobacco companies to recognize that they have clearly many talents, they continue to convince generation after generation of people to smoke and use their products even though we're decades into knowing it's going to kill us. I have said to them: You're very good at selling things. Try to find something to sell us that won't actually kill us.
So we're dependent on them, we want to protect ourselves. Many of us want them to go out of business. I think there's a solution here, but it's not this bill. It could be several other alternative ways for the State of New York to protect itself. But really we should be focusing on expanding our programs to discourage people from smoking from helping them never start smoking.
Thank you, Mr. President. I'll be a no.
ACTING PRESIDENT GRIFFO:Seeing and hearing no other Senator that wishes to be heard, the debate is closed.
The Secretary will ring the bell.
Senator DeFrancisco.
SENATOR DeFRANCISCO: Yes, on consent, we're going to do a noncontroversial vote on this bill in order not to have to wait for our delinquents.
ACTING PRESIDENT GRIFFO:Okay. The Secretary will read the last section.
THE SECRETARY:Section 2. This act shall take effect on the 30th day.
ACTING PRESIDENT GRIFFO:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT GRIFFO:Senator DeFrancisco.
SENATOR DeFRANCISCO: I just wanted to mention one fact that was brought up, I didn't have the answer at the time. But the $250 million that this bill would call for is the highest in the country.
Thank you.
ACTING PRESIDENT GRIFFO:Announce the results.

SENATOR DeFRANCISCO: Could we now go to Calendar Number 1420 on the controversial -- oh, excuse me. Time out. Time out. Time out. This is a new rule, time out.
Calendar 1420 should be laid aside for the day.
ACTING PRESIDENT GRIFFO:Calendar Number 1420, by Senator DeFrancisco, will be laid aside for the day.
