Hallelujah. I greet you in the precious name of our Lord and Savior Jesus Christ. Let us pray.
Our Father who art in heaven, hallowed be Thy name. Thy kingdom come, Thy will be done on earth as it is in heaven. Give us this day our daily bread, and forgive us our trespasses, as we forgive those who trespass against us. Lead us not into temptation, but deliver us from evil. For Thine is the kingdom, the power, and the glory forever and ever.
This day we thank You, O God, for great is Thy faithfulness. Every morning You must see as we see. We bless this house today in no other name but in Your name, where Democrats and Republicans come together, O God, under Your name, just to rule this great nation. We thank You for the President and those that come together to work under God for this great nation.
This morning I bless this house and all those that take part in governing this mighty nation. I pray that Your name will be exalted, for Thou hast done great things even in time past, and we look forward for greater things.
I pray, God, You will bless this land -- every corner, every boundary, every nation, every town, every language. That America will be America, one nation under God.

I want to thank Senator Gallivan, who's been my partner in this effort, as chairman of the Crime Victims Committee. We together worked on a report that we put out about a month ago. And again, a number of pieces of legislation that came from that report are before us today.

ACTING PRESIDENT O'MARA:Senator Klein to explain your vote.
SENATOR KLEIN:Thank you, Mr. President.
Today we're here because of one small but very brave little champion named Luis Oyola, also known as Luisito.
On a late August afternoon in the Bronx, unfortunately something happened that happens too many times in areas around the City of New York. It was a summer day, and it was coming to an end, and a heated argument broke out between two men in Vidalia Park in the Bronx. At the same time, little Luis was enjoying a happy day with his family just a few feet away. As the argument between the two men intensified, guns were drawn and bullets flew, hitting little Luis in the arm, just three years old at the time.
Luckily, Luis was rushed to St. Barnabas Hospital in the Bronx, where the emergency room doctors were able to retrieve the bullet and mend Luis's arm just in time to escape long-term damage, and he was thankfully able to have a full recovery.
Unfortunately, this happens quite often throughout areas in our state. Unbeknownst to many, gun violence is something that even occurs in school playgrounds as well as parks. That led myself and I know Assemblyman Luis Sepulveda, who I believe is in the chamber with us today, to collaborate and put forth legislation which we're calling Luisito's Law.
One of the things that we have to be very mindful of is that our playgrounds are meant to be playgrounds. They're not supposed to be shooting galleries. And unfortunately, gun violence in my borough of the Bronx is on the rise. Just over the past two years, at least four other young children have been injured by gunfire in Bronx parks, including another incident at the very same park that Luisito was injured in back in 2012.
This led us to introduce legislation which I think will go a long way towards curbing gun violence. And I think what we're doing by introducing and passing this legislation is sending a very simple but strong message to criminals: If you take aim at our children, we will fire right back.
This legislation would make it a B felony to injure a child under 10 years old with any deadly weapon, with a sentence of up to 25 years. It would also increase penalties for violent crimes committed with a gun in or near school grounds or playgrounds, and could carry up to 15 years in prison. These places are sacred ground and need to be immune to senseless crimes, and I think this bill will help keep our schoolyards and playgrounds safe places where children and their families can continue to make happy memories.
Mr. President, I vote yes, and I look forward to quick passage in the Assembly as well.
Thank you.

ACTING PRESIDENT O'MARA:Senator Nozzolio to explain your vote.
SENATOR NOZZOLIO:Mr. President, yes, thank you very much, on Calendar 766.
This measure, along with a number of other measures that are being enacted today, are part of an effort established to prevent the very serious crimes of elder abuse.
I want to thank my colleagues Senator Valesky, Senator Carlucci and others who participated in helping prevent a serious occurrence that happens virtually every second in America, where a vulnerable senior citizen is part of a fraud, part of an abuse. And that nonetheless, I hope that this measure, along with measures that are being proffered today by a number of our members, are placed with greatest consideration and enacted with very deliberate speed by the New York State Assembly.
Our vulnerable senior citizens should not be preyed upon. This is a state that should provide protections to our seniors to ensure that they can live in the quality of life that they deserve.
So, Mr. President and my colleagues, I thank all of us for supporting these measures. I also hasten to add that Senator Gallivan was very active in these efforts as well, to ensure that the most vulnerable are cared for in our state, that laws protect them, and that the prosecution of those laws will be to the fullest of those who cross the line and prey on our most vulnerable, our senior population.
Thank you, Mr. President. I urge an aye vote on this measure today.

ACTING PRESIDENT O'MARA:Senator DeFrancisco to explain your vote.
SENATOR DeFRANCISCO: Yes. I certainly have nothing against employees of the Office of Children and Family Services who are added to an ever-growing list of people who, if assaulted, the assault results in an assault in the second degree rather than assault in the third degree.
I've spoken on many of these bills. The exception as to who the victim might be that would elevate an assault from third degree to second degree keeps on expanding in many different bills, and we have two more on today.
And I just want to indicate that no matter who the victim is, if you're employed in a situation where an assault prevents you from performing your duties, why shouldn't everybody be treated the same way, rather than ever-expanding those privileged victims or the victims who the defendant is going to be charged with a greater assault.
So I'm going to vote no.
ACTING PRESIDENT O'MARA:Senator DeFrancisco to be recorded in the negative.
The Secretary will announce the result.

ACTING PRESIDENT O'MARA:Senator Squadron to explain your vote.
SENATOR SQUADRON:Thank you very much, Mr. President.
There are a lot of good parts to this bill and parts that I agree with and would like to see become law, I know as applies to summer camps and others. Unfortunately, this bill has an additional provision in it, which is that any kid 12 years old or older who refuses to get off a bus when they're told to can be charged with a Class A misdemeanor. You can't do it if you're under 12, but if you're 12 or older you can be charged with a Class A misdemeanor for not getting off a bus.
That means kids 12 to 15 in this state would go from school to the juvenile system for literally refusing to get off a bus, criminal trespass of a bus in the second degree, and a 16-year-old at school who didn't get off the bus when they're told to, criminal record. That's not something that I think any of us should support. The path from school to jail doesn't make sense.
Otherwise, a very good bill. I'm going to vote no because I don't think we should be sending kids into the juvenile system at 12 years old for not getting off the bus. They should get off the bus, but it's not a criminal act. And I look forward to an opportunity to vote for most of the other provisions in this bill in the affirmative.
I'll vote no, Mr. President.

ACTING PRESIDENT O'MARA:Senator Ball to explain your vote.
SENATOR BALL:Yeah, just briefly on this piece of legislation.
We're working with an organization called Purple Heart Homes, with John Gallina and Dale Beatty, both combat vets that are service-disabled veterans that were injured in combat. They started an organization, they were actually nominated by CNN. And they were here, I think many of you will remember them. And we're working with them to build and renovate homes all throughout the state.
In my district we have a Vietnam vet, a service-disabled vet that took shrapnel to the head, was never welcomed home properly. And about six months ago, maybe a little bit more, my office got a call that this veteran was going to become homeless. And that he doesn't even have a functioning shower, works at the local supermarket and uses the local gym early in the morning for his shower.
We haven't always done the right thing by our vets, and this organization is picking up that slack, a lot of good work. But the reason why we've done this, and digging into even if you have a not-for-profit that's willing to donate their time, their services, their money, or if you have individuals that are willing to donate property, even in my district, especially in my district, but in all of our districts, we know the expense of property taxes.
We had a piece of property that was going to be donated, it was 10 acres that was going to be donated for a service-disabled vet, but the taxes on that property over $20,000. So even if that service-disabled vet could benefit from that home being donated to them, they wouldn't be able to afford the property taxes.
And we have to realize that they're men and women that have had arms lost, legs blown off. And we may think that there's a huge payday. They're lucky if they're making $2500, $3,000, $4,000 a month after they lost both of their legs in service to this country. So they cannot afford those property taxes.
Other states, great states, not dissimilar to New York -- and also a great state -- but states like Texas have allowed this exemption. This is critically important. And I hope that at some point -- if not this year, soon -- the Assembly will pass this bill as well.
Thanks.

It's really a pleasure to have them here with us today. They are studying and learning about government. And we always know they've got some great educators with them. Teachers are very important. And I've learned that we always should listen and to respect our teachers. There's particularly one that has made sure that that happens to me, and someone who's very special to me, my wife, Lorraine, who is one of the teachers in the gallery today.
So welcome to all of you.

ACTING PRESIDENT O'MARA:Senator Carlucci to explain your vote.
SENATOR CARLUCCI:Yes, thank you, Mr. President.
I want to thank my colleagues for supporting this legislation. This legislation that we're passing here today gives parents another tool to help them pay for their children's education.
What we're doing today is setting up a prepay tuition program to allow for parents and family members to be able to buy credits when their children might be attending college 10, 15 -- in my case, with my 10-month-old son, he'll be going to college hopefully in the next 18 years.
And so if we look at the inflation rate of higher education in the United States, we're talking about 7 percent a year. That means by the time that Jack, my son, is ready to go to college, I could expect to pay double or maybe even triple what people are paying today.
So this is a tool that I believe will go a long way to help make sure that more families can afford higher education in the coming years and many years to come. So I want to thank my colleagues for supporting this.
Mr. President, I'll be in the affirmative.

ACTING PRESIDENT O'MARA:Senator Montgomery to explain your vote.
SENATOR MONTGOMERY:Yes, Mr. President, I would just like to explain my vote.
I wanted to compliment Senator Flanagan. He's worked on this issue for some time, some years now, and finally we're voting on it. And I certainly hope that this year it's going to actually pass both houses and be signed by the Governor.
It provides for a mechanism for making sure that we have a stream of funding available for a program that our state has instituted in high schools throughout the state, and it's called the Early College High School program, which allows for young people, high school students, to actually take college credits and high schools to be partnering with colleges in a way that allows those young people to have college professors teaching some of their classes.
And in fact, in some instances they will be able to graduate from high school with college credits and even, in some cases, a two-year college degree.
So this is really a very important program. And again I say to Senator Flanagan, thank you for hanging in there. I know it's been a long time negotiating this legislation. But we now finally have it before us, and I certainly hope that it becomes law this year.
Thank you, Mr. President. I vote aye.

ACTING PRESIDENT O'MARA:Senator DeFrancisco to explain your vote.
SENATOR DeFRANCISCO: Yes. This is another one of those bills where we keep adding people to the preferred victim list in order to enhance the penalty. And of course firefighters should be at the same level as emergency medical services professionals. And maybe social workers should be as well, to enhance the penalty.
I'm voting no because everyone that's assaulted in this regard, no matter who the victim is, should have the defendant's crime elevated to a higher degree. We're getting very close to filling in every single possibility without saying that any potential victim is -- the defendant is required to get the enhanced penalty. So I'll vote no for that reason.

ACTING PRESIDENT O'MARA:Senator Grisanti to explain your vote.
SENATOR GRISANTI:Thank you, Mr. President.
My fellow colleagues, we know that this past budget cycle we did something extraordinary, and that was put a huge dent in the Gap Elimination Adjustment to help school districts get back the money that they needed. Our conference fought for that, over eight times the Assembly doubling the Governor.
This is another piece of legislation, however, that allows school districts to advertise on their athletic fields. Now, in the rural areas, some of these athletic fields, that's all that they have in their community. This is what they do on a Friday night, this is what they do on a Saturday night.
The advertising, which is restricted from alcohol, tobacco -- sorry, no political advertisements allowed either in the legislation. But the school district decides two things. One, if they want to do it, so it's not a mandate. And two, what ads are going to be placed on these athletic fields.
This is a huge revenue source, huge, that the school districts keep 100 percent that they can utilize for any extracurricular activities, keeping a teacher on staff, having after-school programs, have tutoring. This is another tool that they will have to allow them to raise revenue.
I vote aye, urge my colleagues all to do the same. And to tell your friends in the Assembly. They've got to get this passed, it's a no-brainer for the school districts.
Thank you, Mr. President.

ACTING PRESIDENT O'MARA:Senator DeFrancisco to explain your vote.
SENATOR DeFRANCISCO: Yes, I'm going to vote no. The same reason, we're making more and more exceptions.
I've got to take some time on this, because this is a special bill. I said at one time that we're going to get every single person possible. This bill has done it. So these people, if they're assaulted, result in an assault in the second degree rather than third degree.
Currently it's a train operator, a ticket inspector, a conductor, a signal person, a bus operator, a station agent. And we're adding a station customer assistant, any persons whose official duties include the sale of tickets, passes, vouchers, or other payment of a fare to use a train or a bus, any person whose official duties include the maintenance or operation of a train or bus, or any person whose official duties include the maintenance or operation of a train or bus station or terminal. We've got everybody except the rider.
So I would hope that very soon we put a bill in to include everybody who's being transported by some transit agency in the State of New York, and then we've got it.
So I'm going to vote no.
ACTING PRESIDENT O'MARA:Senator DeFrancisco to be recorded in the negative.

ACTING PRESIDENT O'MARA:Senator Carlucci to explain your vote.
SENATOR CARLUCCI:Thank you, Mr. President.
The issue of the cost of tolls around New York State is a huge problem and something that I believe is really unique to New York and particularly the metropolitan region of this state. In fact, you can drive from Westchester all the way up to Boston and not pay a single toll, but if you want to drive from Rockland to Long Island, you're going to hit toll after toll after toll.
That means that middle-class families, their quality of life is being eroded by just the cost of just getting to work. It's costing more and more. So we have to turn over every stone and make sure every option is on the table when it comes to mitigating the cost of tolls.
This legislation that we're passing today really brings the rules governing New York into the 21st century, allowing toll-collecting agencies and authorities to work with other agencies in the state to go after and suspend a chronic toll evader's vehicle registration. This is a real important issue, because we're losing -- about $30 million a year is going out the window. That's $30 million a year that could be used for infrastructure improvements to make sure that our bridges are safe and secure.
So I want to thank my colleagues for supporting this legislation. I believe we'll be able to save money and make sure that we keep our tolls as low as possible.
Thank you, Mr. President.

ACTING PRESIDENT O'MARA:Senator Grisanti to explain your vote.
SENATOR GRISANTI:Yes, thanks again, Mr. President.
My fellow colleagues, you may have remembered last week we had numerous individuals that were here that had flashing hearts on their lapels. That was for this legislation. This legislation is CPR in schools.
And I want to mention the American Heart Association for all their hard work, all the other groups -- police, fire, EMTs, veterans organizations -- that put forth a strong effort to get this passed.
But I'd be remiss not to mention a couple of things first. I want to acknowledge a constituent of mine, Suzy McCarthy, who lost her 5-year-old daughter Madison, who they believe fainted while she was in kindergarten class. She laid there for 16 minutes because they basically just thought she fainted, nobody performed CPR. She ended up passing.
In your districts, I want to mention Robbie Levine, from Merrick, New York, 9 years old when he died of sudden cardiac arrest. Louis Acompora, from Northport, New York, 14 years old, that died.
When they were here in the Well the other day, it was sad, because on one side they had those that survived cardiac arrest because CPR was performed on them, and on the other side on the banners they had kids that died because CPR was not available.
This is something that can be taught in less time than it takes to watch an infomercial or Gilligan's Island or The Brady Bunch -- I may be showing my age now. But basically, 30 minutes.
And it's not blowing in the mouth anymore, ladies and gentlemen, it's hands-on CPR. It's something that the American Heart Association recognizes. Seventeen other states have enacted this. This is not a mandate. It tells the Board of Regents to go ahead and ask the State Board of Education how to implement this program in a proper fashion. It can be taught in health class, it can be taught in gym, it can be taught after school.
But in my district, in my district Molly Budzinski showed how easy it was. She brought it to her own school by getting volunteers from the fire department, EMTs and ambulance workers that came in with the materials to teach this. In 30 minutes, and then you're on your way.
So in memory of Madison McCarthy, Julie Hart, who fought hard for this for the American Heart Association -- and yes, her last name is Hart. So when she was born we know where she was going to be in her lifetime now. But in memory of Madison McCarthy, all those that passed because CPR wasn't available, I'm proud to sponsor this legislation.
It must move in the Assembly. This is the closest it's ever been. Tell your colleagues there's no reason why we should not teach our students in our schools this vital technique for saving lives that they will carry with them for the rest of their lives and utilize it, whether it's in a school ground, in a movie theater, on the sidewalk or in a restaurant.
It's something we should have, and I'm proud to sponsor it.
I vote aye, Mr. President.
ACTING PRESIDENT O'MARA:Senator Grisanti in the affirmative.
Senator Montgomery to explain your vote.
SENATOR MONTGOMERY:Yes, Mr. President.
This really is a very good bill. I'm very pleased that Senator Grisanti is putting forth this legislation.
I would, however, suggest that I have a bill as well which would require first responders to have, as part of their training, CPR. And it's because there was a child that also died in my district, and for the same reason as you express about the child being actually saved because of the ability of someone to administer CPR. Unfortunately, the child in my district did not survive.
And so there is legislation which would do exactly the same thing except to add a group of very important people to your bill, to your concept, and that would be first responders in the State of New York.
So I'm certainly voting yes on this. I certainly hope that we could consider the possibility of amending this legislation to include the people that would be covered in my legislation as well.
Thank you, Mr. President. And I vote aye.
ACTING PRESIDENT O'MARA:Senator Montgomery in the affirmative.
Senator Boyle to explain his vote.
SENATOR BOYLE:Mr. President, to explain my vote.
Very quickly, I'd like to congratulate the author of this legislation. It's vital.
As a former EMT, I can tell you how important CPR is. And for someone in the EMT business, they always talk about the city of Seattle. If you ever want to have a heart attack -- and you don't want to have one -- you want to have it in the city of Seattle, where almost 70 percent of the population has been trained in the course of their life on CPR.
I want to make New York State exactly like Seattle so it is the safest state. You never want to have a heart attack, but God forbid you do, you want to have someone there trained in CPR. And this is going to give us a whole new generation of children to do it.
I vote aye.

ACTING PRESIDENT O'MARA:Senator Stavisky to explain your vote.
SENATOR STAVISKY:To explain my vote.
This is what I call a déjà vu bill. We've seen it before in another context. Very briefly, it would provide a baccalaureate program which would require fewer credits to graduate and in fact would be a three-year graduation.
The problem as I see it is that it could jeopardize some of the professional requirements for degrees. It could jeopardize licensure requirements or accreditation programs, as well as admission to graduate schools or for jobs that require a four-year program.
It also could affect the TAP award and the Rational Tuition Policy. The cost of this bill is capped at $12,000 for the three-year period, while the average tuition for a year of on-campus learning is approximately $5500 a year or so. So there's not a large savings, but there is a savings to the student.
However, the student with the online learning is losing the human contact with a professor. And the absence of counseling -- which some students may be suited for online classes, some may not. Some require the human touch.
The last problem that I see as major problem are the out-of-state students, because we have students from out of state who pay an additional tuition charge. And yet a student in Idaho or North Dakota can log on, take our courses, and at the same time pay the same $12,000 for the three-year programs.
Lastly, SUNY students tend -- on-campus students tend to graduate and stay in New York, contribute to our economy, to the economy. They work in New York, stay and pay taxes in New York State. And that's not going to be true necessarily of the online student in North Dakota or some other remote part of the country.
So, Mr. President, I vote no.

ACTING PRESIDENT O'MARA:Senator Peralta to explain your vote.
SENATOR PERALTA:Thank you, Mr. President.
I applaud Senator LaValle for this bill that's going to increase TAP for students to a maximum of $6,470 a year while increasing the income eligibility from $80,000 to $100,000.
I support this bill because a well-educated workforce, as most of you know -- or all of you know -- will be better off, our economy will be better off for it, the city and the state. Because the better educated one is, the higher potential salary one will receive. Then in turn, that will lead to more revenue to the state in the form of taxes. And according to Comptroller DiNapoli, we're talking over $60,000 over the lifetime of someone who receives a bachelor's degree.
A college education is more important today than it ever has been. In today's job market, a college degree is more a necessity now than a luxury. In 2013, a staggering 22 percent of young adults age 25 to 32 who had attained only a high school diploma lived in poverty, compared to only 7 percent back in 1979.
I also understand that families from all across the state are struggling to pay for college. I support increasing the maximum TAP award. And, given the costs of college these days, taking a look at income-eligibility thresholds makes sense as well, just as this one. But this bill only reinforces the desperate need to open higher education to all young New Yorkers, including the children of undocumented New Yorkers, those kids we call Dreamers.
The fact that there are young people from all types of backgrounds struggling to pay for college is not a reason to deny help to these Dreamers, it's a reason to provide help to everyone. As I stated earlier, among the myriad reasons for making college more affordable for everyone is the simple fact that the more educated our workforce is, the better it is for our economy, for our state, and our city.
And make no mistake, Dreamers will most certainly be part of our workforce. These are young people who don't know any country other than the United States of America. Their hearts are here, their futures are here. Makes into sense to punish them for something that their parents did. It makes sense to help them succeed so New York as a whole can succeed.
So yes, we need to talk about raising the maximum TAP grant. And yes, it, makes sense to consider raising the income eligibility threshold. But we also need to open college up to everyone. We need to pass the Deem Act.
I'll be voting yea. Thank you, Mr. President.

ACTING PRESIDENT O'MARA:Senator Lanza to explain your vote.
SENATOR LANZA:Thank you, Mr. President.
My colleagues, the idea that one person can own another was to have been extinguished in this country 150 years ago. Sadly, some people have not heard the message. Unfortunately, thousands upon thousands of young people, mostly girls, are put into sexual bondage every year in this state. And in fact, our state is the state where it occurs more than any other place in the country.
This bill, the Trafficking Victims Protection and Justice Act, would change that. It would finally treat the criminals as criminals and victims as victims. I told the story last year that as I researched this legislation, I came across a story about a young girl who, because of the stress of life, ran away from home. She found herself in the streets, and she was abducted, for all intents and purposes. And she was not able to come and go as she pleased. A man decided that her life and her body belonged to him, and he pressed her into a life of sexual bondage. And when the government finally showed up, they arrested her.
And as I read the story, I thought to myself, in which century has this occurred? In which country has this occurred? And the sad fact is that this is occurring in the here and the now, and we need to do something about it and we need to stop it.
This bill will do that. It is not often, my colleagues, that we have the opportunity to pass legislation, to make a law that will actually save lives. What wouldn't you do to save one young girl from this horror? What wouldn't you do to save a hundred or a thousand or 10,000? That's what we will be doing if we can make this bill become a law. We will save the thousands, hopefully, who are being treated this way who don't have their own lives any longer, who are pressed into this horror. And I think we will go a long way in ensuring that girls of tomorrow will not endure this hell.
And so, my colleagues, I thank you for the bipartisan support we've had on this legislation. In particular, I want to thank Assemblywoman Paulin, who, because of misdirected politics, is having to move mountains in order to achieve what is a very common-sense, long overdue, and critically important piece of legislation in the Assembly, and she's doing it. And I thank her for her leadership there.
I thank all the advocates. I thank the leaders in this chamber. And I thank all of you, my colleagues, for your support of this very, very important legislation.
Thank you, Mr. President.
ACTING PRESIDENT O'MARA:Senator Lanza to be recorded in the affirmative.
Senator Savino to explain your vote.
SENATOR SAVINO:Thank you, Mr. President.
I rise in support of this legislation. And I want to thank my colleague from Staten Island, Senator Lanza, for his leadership on this issue. He's been working on this bill for several years now, as, as has been mentioned, Assemblywoman Amy Paulin, who has been relentless in her efforts to bring a bill like this through both houses of the Legislature.
Just about a month ago, many of us in the international community were shocked when we saw what was happening in Nigeria when the Boko Haram had kidnapped 200 schoolgirls from a Catholic school. And they disappeared, not to be found yet, into the sex trades. And I attended several vigils for those young girls, as many of you did, calling on the international community to demand the return of these young girls.
And at every one of these vigils we all had a chance to talk about the horror of what was happening there and how we were shocked and aghast about the treatment of these young girls and the plight of young women in some of these far-flung countries. And at each one of these I took the opportunity to remind people that while we were shocked and horrified, and rightfully so, human trafficking is happening in our own communities in right here in New York.
In the communities of Sunset Park, where we have a high degree of Chinese immigrants, human trafficking happens every day. We're seeing it in the immigrant communities of Staten Island, young girls are being trafficked every day.
So while we express horror about what's happening in Nigeria, we can't ignore what's happening in our own communities. And this bill is a step in that direction. We may not be able to prevent what's happening in those far-flung nations, but we can certainly do more to see to it that young girls, who are usually in this country on their own without protection of family, are not somehow or other brought into the sex trades, into a life they never envisioned when they imagined coming to America.
So I want to thank Senator Lanza and Assemblywoman Paulin for their work on this, and I am very proud to cast my vote in favor of this bill.
ACTING PRESIDENT O'MARA:Senator Savino to be recorded in the affirmative.
Senator Gianaris to explain your vote.
SENATOR GIANARIS:Thank you, Mr. President.
I want to commend Senator Lanza for his efforts on this bill. I'll be voting in favor of it.
But I do want to comment that to suggest it is misguided politics for advocates in the other house to insist that women's reproductive rights are protected, that Roe v. Wade is codified as part of the discussions on this and other bills, is itself misguided and outrageous.
We negotiate bills all the time in this house, and there are differences of opinion to be sure. But it is a perfectly legitimate position to insist that we're not going to divide the advocacy community, we're not going to divide the women of this state into 9/10ths of what they should get. And to suggest that that's misguided is itself misguided, Mr. President.
I vote in favor of this bill, but I continue to call for the full Women's Equality Act to be adopted.
Thank you.
ACTING PRESIDENT O'MARA:Senator Gianaris in the affirmative.
Senator Robach to explain your vote.
SENATOR ROBACH:Yes, Mr. President, I too want to rise, proud to be a cosponsor of this bill, thank Senator Lanza, all the advocates, the Junior League, so many people who got involved in this, as well as many of the other points in this women's agenda on equal pay, other things that I am glad we are taking up in this house and addressing things that most New Yorkers agree on and, more importantly, our constituents want results on.
So this bill in particular, so happy to support. As a father, as a legislator, it's almost hard for me to believe -- you would think in today's day and age this would get rarer. Instead, with technology, communications, it's almost become more abundant than it used to be. That a lot of women from foreign countries who were here were the ones being exploited; now it's equally growing where runaways in this country are being exported to other parts of the world. Completely unacceptable.
So this bill is great in many ways, but it not only increases appropriate penalties for those that exploit young people, but it even goes further to not doubly victimize those people who are held in bondage, used and trapped, and make them the guilty party.
So this is going to go a long way to not only help but also send a clear message that this is going on, it's unacceptable, the world is watching and will take it no longer. Happy to cast my vote in the affirmative.
ACTING PRESIDENT O'MARA:Senator Robach to be recorded in the affirmative.
Senator Libous.
SENATOR LIBOUS:Thank you, Mr. President.
I know that a number of members want to explain their vote, as they should, as they're entitled to. I just want to remind them that they have two minutes to do so. And that while we are always lenient and never want to cut anybody off, I would like the chair to try to keep members to the two minute limit.
ACTING PRESIDENT O'MARA:I'll get my stopwatch.
SENATOR LIBOUS:You're a good man, sir.
ACTING PRESIDENT O'MARA:Senator Grisanti to explain his vote. In two minutes or less.
SENATOR GRISANTI:Yes, thank you, Mr. President.
You know, Senator Lanza, I want to actually commend you and thank you for this piece of legislation. I'm proud to cosponsor it.
In Western New York we actually held human trafficking hearings, and we had a few of them. And the first one, really, you know, not too many people showed up. I don't think people actually realize that it exists. I mean, it exists and is multiplying at an alarming rate. And the second hearing we had, more people started showing up, more people started showing up.
Then we started seeing billboards of individuals that said "He promised me a job," "She promised me a job." That's what they do. They lure you in, whether you're coming here, you don't know the language that well, you're coming here, you're taken advantage of, or if you're actually born here, you're taken advantage of. The runaways, as Senator Robach has stated.
So this legislation not only increases the penalties, but it brings awareness that human trafficking is alive and well and we have to do everything in our power to stop it as fast as possible.
So I vote aye, Mr. President. Thank you.
ACTING PRESIDENT O'MARA:Senator Grisanti to be recorded in the affirmative.
Senator Peralta to explain your vote.
SENATOR PERALTA:Thank you, Mr. President.
I too will be voting in the affirmative. I want to thank Senator Lanza for this piece of legislation.
As it was clearly stated by some of my colleagues, human trafficking is a growing epidemic. And there are various zones in the City of New York where this is happening. And one of those hot zones happens to be in my district, Roosevelt Avenue, where we have women who are trafficked from different parts of the world -- from Mexico, from China, from the Philippines -- and even locally, from the United States of America, who are coming down to Roosevelt Avenue.
And they are promised the world, the American dream. For the most part, their passports are taken, their identification is taken, and they are told, once they get to Roosevelt Avenue, that they have no other alternative. If they want their family to live, if they want their significant others to stay alive, that they will have to pay back the cost of the trip or the support that they are giving them.
So these women are slaves. And we have to acknowledge that these women are enslaved, and we have to do something about it. And this piece of legislation will be very helpful in educating those who don't know about the human trafficking world and the hot zones that exist not only in New York City but throughout the State of New York.
And it's very important to ensure that we are on the side of the victims. Usually they say this is a victimless crime. It's not a victimless crime, because these women are the victims. And we need to ensure that we protect these women who, by no fault of their own, they are promised this American dream, their passports taken away, and then when they land here or when they get to -- usually, in my district, they are living the American nightmare.
And that's something we need to do something about, and I am going to be voting in favor of this.
So thank you very much, Mr. President.
ACTING PRESIDENT O'MARA:Senator Peralta to be recorded in the affirmative.
Senator Dilan to explain your vote.
SENATOR DILAN:Yes, Mr. President, I rise in support of this piece of legislation. I'd like to thank all the prime sponsors and those that will be voting.
Just last week I met with a constituent who was a victim of sexual bondage. And this piece of legislation will go a long way to ensure that similar victims in the future will not be victimized twice -- once by the perpetrator and then secondly by our own judicial system and, believe it or not, our police department.
Hopefully the judicial system and the police academy can also include sensitivity training for those involved in our justice system to ensure that these individuals are not victimized twice.
And also, with four days remaining after today, I hope that the whole ten point Women's Equality Act can pass this house.
Thank you. I vote yes.
ACTING PRESIDENT O'MARA:Senator Dilan to be recorded in the affirmative.
Senator Hannon to explain your vote.
SENATOR HANNON:Thank you, Mr. President.
I just want to commend Senator Lanza for carrying this.
And I wanted to add that through some participation with national organizations, I got a chance to know that New York's law, which we had adopted decades ago, had just become outmoded because the people who prey on the innocents have adopted new techniques.
And while it's been correctly noted many times this comes about because of immigrants, I was also astounded to find out that the prey comes about from the teenage girl who is in America who is lost, is without goal, and there's a whole concept by these evildoers of grooming.
And so it's not just the immigrant population, as vulnerable as they may be, that we have to be concerned about. And it just underscores the need for this legislation to protect the young women of this state from being preyed upon.
And I vote aye.
ACTING PRESIDENT O'MARA:Senator Hannon to be recorded in the affirmative.
Senator Sanders to explain your vote.
SENATOR SANDERS:Thank you, Mr. President.
I too have to join the chorus that is congratulating Senator Lanza and the others who have put up this magnificent piece of work.
I want to say that this is an example of thinking globally but acting locally. That there are many parts in the world we have to do something about, but we should always start with our own backyard. We should always start with where we can actually do something about the issue.
And this issue is clear to me. I have Kennedy Airport and other places, and this is going to be one of the targets of this horrible trade.
Now, I do want to say that this affects more than women; it also affects young boys and men. So I'm glad that this encompasses all. It's necessary to understand that this is attacking all people.
While we are trying to figure out the best ways of dealing with the world situation, again, starting in New York, the Empire State, we have to let people know that this is not going to be the center of this trade, that we in the Empire State have a government that is committed to making sure that this type of crime is stamped out.
And this is a great act towards this, and I'm glad to be voting yes.
ACTING PRESIDENT O'MARA:Senator Sanders to be recorded in the affirmative.
Senator Bonacic to explain your vote.
SENATOR BONACIC:Thank you, Mr. President.
I also rise to thank Senator Lanza for his hard work on this subject.
This body is voting probably unanimously for this bill. We all know that trafficking of women, where it leads them is to a form of slavery, to prostitution, to drug addiction and/or death. Every day that the Assembly delays in passing this legislation is a crime on women.
I vote yes. Thank you, Mr. President.
ACTING PRESIDENT O'MARA:Senator Bonacic to be recorded in the affirmative.
Senator DeFrancisco to explain his vote.
SENATOR DeFRANCISCO: I agree with everything that everyone has said. This is obviously an important bill. It's obviously a bill that will save women, young women, young boys. It's obviously a bill that we're all going to support.
We could have had a law this time last year -- last year. This could be in law. And the provisions of this bill, because we passed it last year, could be law and could have saved untold number of young women and young men for a year. And why is it not being passed? Because of the political maneuver that we need everything, the 10-point agenda or nothing.
Are you kidding me? Are you kidding me? A bill as necessary as this. The same can be said for the other eight points that we passed last year. All or nothing. Because it wouldn't be a woman's agenda.
God knows how many young women have been hurt because of this political nonsense about all 10 or nothing. Every bill can stand on its own. If it's a meritorious bill, it can pass in both houses.
I see we have Assemblywoman Paulin here. I'm sure she would agree with that. It's her bill; she wants her bill to be passed.
So I think if we're this much in favor of this bill, unanimously and passionately, we should all march over to the Speaker and tell him, put the bill on the agenda. Let's vote on this bill and not waste another year because we want to play the all or nothing politics. That's childish, it's dangerous and it's wrong.
I vote aye.
ACTING PRESIDENT O'MARA:Senator DeFrancisco to be recorded in the affirmative.
Senator Martins to explain your vote.
SENATOR MARTINS:Thank you, Mr. President.
You have to wonder what's going on here in Albany. There are 10 bills out there, nine of them which we have passed in the past. Nine bills that could have prevented people from being taken advantage of, young women, whether it's here, whether it's people who are recently arrived in the country, from being taken advantage of. These bills can make a difference, and yet they're being held up. We have colleagues in the Assembly who have supported each one of these nine bills in the past, but they can't get an opportunity to vote for them because leadership in the Assembly won't allow them on the floor. It's wrong.
I join my colleagues here in supporting this bill -- obviously it's unanimous -- and some of our colleagues in the Assembly who are calling for it. But if each one of us does our part on both sides of the aisle, if we take the opportunity to reach out to our colleagues in the Assembly -- aren't our women in New York State worth it? Aren't our children worth it? Isn't the health and integrity of women in this state worth it?
We can do this this year. Mr. President, if each and every one of us takes that additional step -- and I'm speaking specifically to both sides of the aisle -- this can happen this year. Not just this bill, but the other eight as well.
I vote aye.
ACTING PRESIDENT O'MARA:Senator Martins to be recorded in the affirmative.
Senator Stavisky to explain your vote.
SENATOR STAVISKY:Yes. Mr. President, as I sit here I'm saddened by the interjection of politics into a very significant issue, the issue of trafficking.
This is not a political issue. It's really not a women's issue either. It's an issue of the people of the State of New York to oppose the trafficking.
And I vote aye.
ACTING PRESIDENT O'MARA:Senator Stavisky in the affirmative.
Seeing no other Senator wishing to explain your vote -- seeing one more, Senator Parker, wishing to explain his vote.
SENATOR PARKER:Thank you, Mr. President, I'd like to explain my vote.
Let me add my voice to the chorus of those who are congratulating Senator Lanza on this great bill. And I think none of us disagree about how important it is to protect, you know, particularly women but all members of our society from sex trafficking and the illegal sex trade in not just this state but around the country. So we certainly stand in support of this bill, and I'd like to see us go further.
However, I don't think that the women, whether they have been victims of sex trafficking or other crimes, think that it is just politics to protect them from housing discrimination. They don't think that it's just politics that they receive 77 cents on the dollar to every man as they work right this minute and hear this debate. I don't think they think it's just politics when they are denied their reproductive health rights or they are told that they have to go through all these extra hoops to receive reproductive health care in this state.
And so I think when we talk about the whole 10 points of the Women's Equality Agenda, those women want to see all of those things being done. Including the women who are being protected by this act, who want to see that entire package go forward.
So I join with my colleagues who have been championing the cause of women's equality, not just on the selective morality that we sometimes hear about, but on all the things that are important for women in the State of New York.
ACTING PRESIDENT O'MARA:Senator Parker to be recorded in the affirmative.
Senator Ball to explain his vote.
SENATOR BALL:So as somebody who's not running for reelection, let me just set this straight. The people who are watching right now can be saddened by the politics of what has happened in this state.
We're talking about an extreme leftist movement that, out of 10 planks, nine of which protect our families and women in New York State, which the Republicans in this Senate have passed, they hold all that up, including protecting women and children from sex trafficking, and they hold that up for a tenth plank that is not about reproductive health or rights, but it is an assault on women's health and rights because it would actually allow nondoctors to perform abortions until the ninth month.
Because on the left in this state, they have gone so far, they have no other issues, they've got to jump off the cliff. In the name of women's health, they not only hold up laws protecting folks against human trafficking, and eight others, but they have a full-out assault on women's health to allow nondoctors to perform abortions until the ninth month.
The only extremists in this chamber are on the left, the far left, and that fact is never more clear than right now today.
ACTING PRESIDENT O'MARA:Senator Ball to be recorded in the affirmative.
Seeing no other Senator wishing to explain their vote, announce the result.
THE SECRETARY:Ayes, 57.
ACTING PRESIDENT O'MARA:The bill is passed.
THE SECRETARY:Calendar Number 1366, by Senator Hannon, Senate Print 5880, an act to amend the Executive Law.
ACTING PRESIDENT O'MARA:Read the last section.
THE SECRETARY:Section 4. This act shall take effect on the 90th day.
ACTING PRESIDENT O'MARA:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT O'MARA:Senator Hannon to explain his vote.
SENATOR HANNON:Thank you, Mr. President.
I rise in support of this legislation which would fill a very serious gap in existing law so that it would end discrimination against women who are pregnant while they're on the job.
The results of a study done by the National Women's Center and titled "It Would Be a Heavy Lift" has demonstrated that there are too many situations, far too many situations, where pregnant women are often forced to choose between their health and their job when both could be maintained with modest adjustments, such as bathroom breaks, water breaks, seating accommodations. Reasonable accommodations.
Some examples that have been shared with me include a fast-food restaurant worker who was denied permission to drink water and eat during an eight-hour shift. Or a cashier who could easily have been accommodated merely with a stool to sit on.
People think that this whole situation had been addressed by a combination of federal and state laws, but it's not. It's a glaring omission. And you think that in the absence of this statute what we're doing is saying to somebody who is pregnant: No, you can't continue to work. No, you can't continue to have your usual routine. And that just puts an economic burden on the rest of society.
So I would urge that this measure be passed and it be passed in both houses. Focused on the merits of the measure alone, it will be a substantial addition to the laws of this state but, more importantly, it will be a substantial protection to women who are pregnant and working.
Thank you.
ACTING PRESIDENT O'MARA:Senator Hannon to be recorded in the affirmative.
Senator Little to explain your vote.
SENATOR LITTLE:Thank you, Mr. President.
Thank you, Senator Hannon, for the bill. And I'm proud to be a cosponsor of it.
While this doesn't have as high a profile as the bill that we did just before this, this certainly is an important piece of legislation. We all know today that many more women work and are a large percentage of the workforce, and many women work through their entire pregnancy, right up to being 8½ months, almost to the day that they deliver.
And all we're asking for in this, while pregnancy is not a disability, it is a condition that does require some extra considerations. And all we're asking for in this is some reasonable considerations. A professional woman, I would ask, wouldn't be required to go on a conference trip when she's 8½ months pregnant. Things like that.
Things that are reasonable and yet the person can still get the job done, but a woman would not have to then consider her health and the condition of the delivery and how soon the delivery was, how she felt, all of those things, at the detriment of her job. That's all we're asking for.
It also requires some responsibility on the part of the employee that they show the need for these reasonable accommodations. But it's really a very good bill and very considerate.
It takes me back to I did a paper on the history of women in the Legislature, and a very, very long time ago, women legislators, one in the Assembly, one in the Senate, proposed a bill that would require a stool for all retail clerks who may be on an eight-hour shift in a store and never had a chance to sit down, and for elevator operators. And until our elevators were automatically operated, you must have noticed there was always a stool there.
And so that was for men and for women, but it was an accommodation to a job. And I think that that's exactly what this is, and I vote aye and encourage all of my colleagues to vote aye.
Thank you.

SENATOR FARLEY:Thank you, Mr. President.
On a point of personal privilege, I'd like to take this moment to tell you about I think one of the most beloved ex-presidents of the United States, President George H.W. Bush, who's having his 90th birthday today. And incidentally, he just parachuted out of a helicopter at 90 years of age in Maine today.
And what a remarkable man he is. He's beloved by both sides of the aisle. President Clinton considers him one of his dearest friends. And he's been a personal friend of me and my family for 35 years.
And I'm sure that chamber wishes George H.W. Bush a very happy 90th birthday.
(Applause.)
SENATOR FARLEY:On an equally pleasant note, I'd like to acknowledge that there's another beloved Senator in this house that is having her birthday today. I think she's around 39. It's Senator Marchione's birthday today.
(Applause.)
ACTING PRESIDENT O'MARA:Senator Libous.
SENATOR LIBOUS:Mr. President, I have about 60 people in my district -- no, no, only kidding -- whose birthdays are today.
