ACTING PRESIDENT BOYLE:Senator Breslin.
SENATOR BRESLIN:Thank you, Mr. President.
I will be brief because it's such an important day. But we're in the process of celebrating the 250th anniversary of the Mount Vernon Masonic Lodge No. 3 in Albany, New York. And that goes back to the Revolutionary War times.
And we're proud to have in the audience today the Worshipful Craig Berndt, who's the Master of the Mount Vernon Lodge No. 3 in Albany. And it goes back to a time when Peter Yates was a Mason who was a delegate to the Continental Congress in 1784, and Matt Visscher, who read the Declaration of Independence to the citizens of Albany in 1776, and Tom Van Alstyne, the 61st mayor of Albany.
And a congregation of Masons got together recently, and there were a lot of the most important Masons in the United States congregating here in Albany.
So I'm proud to commend this 250th anniversary and look forward to the next 250.
Thank you very much, Mr. President.

THE SECRETARY:Legislative Resolution Number 2801, by Senator Hassell-Thompson, congratulating Willie L. Rennick upon the occasion of celebrating his 100th Birthday.
ACTING PRESIDENT BOYLE:Senator Hassell-Thompson.
SENATOR HASSELL-THOMPSON:Thank you, Mr. President.
And thank you, Senator DeFrancisco, for allowing this resolution to go forward.
Mr. Willie Rennick is a constituent of mine. But more than that, he is a senior who has reached his 100th birthday. And as someone who is 100 years old, he is totally atypical of what you would think of someone in a nursing home.
This is a gentleman who never learned to drive but who walked throughout his entire community, was a major usher in his church. And because the pastor would see him all over the town, he said "You need to lead our usher board, because you're the kind of person" -- ushers are those that people meet when they first come into the church to make you feel welcome. And certainly Mr. Rennick was someone who did that.
But more than that, Mr. Rennick, who was born in 1915 in Whitmire, South Carolina, was one of 15 children. And he was married to his wife, Louise Sellers, for over 52 years.
And when they relocated to Mount Vernon, they became just the kind of citizen that you want -- the one who kept their yard extraordinary, who kept their children extraordinary, and who attended church and was, you know, such an upstanding community person and such a doting grandfather, not only to his own biological grandchildren but to many of the children within our Sunday school and in our church.
And Mr. Rennick is still trying to walk close to a mile every day at age 100. And so he is a remarkable human being.
And as we celebrate his birthday, he and my dad were good church club members together, and he continues to carry the legacy. And his mind is as clear as anything, and we still have these wonderful conversations about he and my dad serving God in our church and in our community.
So I thank you for allowing me the opportunity to enter Mr. Willie Rennick into the Hall of Fame of New York State as he celebrates his 100th birthday.
ACTING PRESIDENT BOYLE:Thank you, Senator Hassell-Thompson, for commemorating this remarkable individual.
Mr. Floor Leader.
SENATOR DeFRANCISCO: Would you please read the noncontroversial calendar.
ACTING PRESIDENT BOYLE:The Secretary will read.
THE SECRETARY:Calendar Number 118, by Senator Farley, Senate Print 2450, an act to amend the Real Property Tax Law.
ACTING PRESIDENT BOYLE:Read the last section.
THE SECRETARY:Section 3. This act shall take effect immediately.
ACTING PRESIDENT BOYLE:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT BOYLE:Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you very much, Mr. President.
I just want to highlight that there have been several bills floating through this year that involve allowing property tax exemptions for a personal home with the home actually being held within an LLC, as opposed to the way most of us own their homes.
I've spoken to the sponsor, and I understand the situation for this unique situation.
I'm voting against the bill and speaking to make clear there are questions we ought to be asking about are we encouraging people to move their private homes into LLC status so they can take advantage of the business tax deductions they are then allowed, but then technically come back and ask for the personal home deductions as well, giving them perhaps a double tax advantage over other people who simply own their own homes in the normal traditional way, and whether there's a slippery slope here for the State of New York of walking down this road.
So I'll be no. Thank you, Mr. President.

ACTING PRESIDENT BOYLE:Senator Hassell-Thompson.
SENATOR HASSELL-THOMPSON:Yes, I rise to explain my vote, Mr. President.
While it is my custom in this chamber to vote in favor of these bills, it is becoming increasingly difficult to understand where people who are considered sex offenders can reside, particularly when we begin to talk about childcare facilities.
These facilities are allowed -- you could have a childcare center in your home and you don't have to give any kind of notification. So that until the shingle is hung, people would not even know that a childcare center has been given license to reside there. So that that would put this person in violation.
And so I think that there needs to be some due consideration given to how we very willy-nilly pass some of these rules in relationship to what's really happening in communities.
So I will be voting no.

I think if the bill had said the economic development department or departments shall create this program and draw through existing funds, it would have been fine. But this adds a new $10 million cost or more without our providing the funding for it.

SENATOR SQUADRON:This is a bill we had a conversation on in committee, and there were a lot of open questions, so I'm surprised to the following week see it on the floor without any of those questions being answered.
There's a basic question about the right to counsel, access to counsel, the ability to have free and open discussion with counsel. The idea of bringing down costs and burdens for the courts and for those being arraigned makes sense. Doing it without having any practical idea how we're going to assure the right to counsel makes no sense at all. For that reason, I vote no.
And in the future, it would be great if discussions we have lead to improvements in bills.
Thank you, Mr. President.

ACTING PRESIDENT BOYLE:The Secretary will ring the bell.
The Secretary will read.
THE SECRETARY:Calendar Number 1420, by Senator DeFrancisco, Senate Print 5131, an act in relation to authorizing.
SENATOR DeFRANCISCO: Last section.
(Laughter.)
SENATOR KRUEGER:Hi. Standing.
ACTING PRESIDENT BOYLE:Senator Krueger.
SENATOR KRUEGER:Hello, Mr. President. Would the sponsor please yield?
ACTING PRESIDENT BOYLE:Will the sponsor yield?
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:Thank you.
Can the sponsor explain what REV is?
SENATOR DeFRANCISCO: Well, I can't, because nobody says anything about it. We had a hearing; nobody quite knows what the components are.
But it's some type of energy program that the Governor is promoting and was supposed to have some reports about it many times. I think there were three different report dates that would keep moving.
And no, I really can't say exactly except it's a clean-energy-type proposal that has the title Reforming the Energy Vision; namely, REV. And so I can't give you specifics other than it's a clean-energy-type proposal that replaces the never-released Energy Highway proposal, which I can't explain either.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:So your bill calls for freezing all monies that fund the REV initiative. But as was just explained, the sponsor isn't clear what REV is.
So can the sponsor explain what monies must be freezed if this bill becomes law? I guess "frozen" would be the correct English.
SENATOR DeFRANCISCO: Well, let me answer it this way. That's a remedy if they don't do the study.
The fact of the matter is we've been waiting for study after -- for deadline date after deadline date after deadline date. Senator Griffo, myself and others, including yourself, held a hearing trying to get more information about what's going on, when are these reports going to happen. And despite the promises, we haven't received anything.
And so the point of this is before we go into another vision, like the Energy Highway vision that was set aside, we ought to know more about the costs and have a cost-benefit analysis and provide some information to the consumers what this is going to mean. So this loss of money can be easily rectified by giving this information out, like they promised they would repeatedly.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes. Yes.
SENATOR KRUEGER:Thank you. And it's a long question.
So REV stands for Reforming the Energy Vision, and there are a number of different steps to it. The REV process is being driven by disruptive technologies already in play: the reality of the staggering cost to maintain an aging generation and delivery system, the imperative to reduce fossil fuel emissions. It's been in process for 18 months, and a diverse set of stockholders have participated.
And the sponsor is correct, there are a number of reports due the Legislature that are late. Although one of them came out, I believe, two days ago. So I think now instead of being three reports late, they're only two reports late.
But in the Senator's bill, would it be the intent for all REV proceedings and process and plans to stop completely until such time as a new report dictated by the bill before us was completed? Which I believe has a date a year from now.
So is it the sponsor's expectation that all the activity that's been moving forward for 18 months -- even though I agree, they're late in getting us information -- should be halted and all funds should be frozen until such time as the report required under this bill was completed and satisfactory to the Legislature?
SENATOR DeFRANCISCO: Not at all. As you can see from paragraph 3, no additional taxes and fees, increased rates or any other charges required to fund the REV initiative shall be imposed upon utility rateholders until the completion of the study.
There's money in this year's budget to do whatever they're doing. But the fact of the matter is this talks about increased fees and the like. And that's the point.
You know, this isn't unusual. We've had many instances where studies are ordered by the Legislature and they just never happen. The irony here is that the reports were -- the dates were given by the administration this time, and they're still not fulfilling their own internal reporting period.
So the only way we can see whether what's going on is something worthwhile is to get a cost-benefit analysis before they start increasing fees and taxes.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:Thank you.
Wouldn't any analysis of the cost benefits and rate impacts of REV and the alternative required by this bill potentially be so broad and general as to not be particularly useful to the Legislature?
SENATOR DeFRANCISCO: Well, it's useful to me. And it's useful to the members of the AARP, who sent a memo in support, to know what additional fees and so forth they're likely to have to pay based upon this new vision that we have. And so no, I think it's extremely important to have that information.
And besides, if this was such a horrible burden I'm trying to impose to get these reports done, they wouldn't have imposed the deadlines on themselves. So I just feel it's not an imposition.
And the prudent way to do things, especially in the billions-of-dollars industry of energy and the potential fees that might result, we should know what we're getting into before we get into it, and I mean financially.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:The sponsor answered the questions around the taxes and fees, et cetera. But is it the intent of this legislation to place the affordability proceedings within the REV on hold as well?
SENATOR DeFRANCISCO: Put the affordability hearing on hold?
SENATOR KRUEGER:Proceedings. Again, REV -- I'm sorry, Mr. President. Through you, to explain.
REV is actually a series of different assignments within the -- I guess the purview of a number of different energy divisions of the State of New York. And one involves the potential for new costs, taxes, fees in order to expand certain new capital activities, and other efforts are specific to actually improving affordability of energy in the State of New York.
Should that also be held off until the reports demanded within this legislation are completed?
SENATOR DeFRANCISCO: This bill, if it became law, would not set aside anything or stop the administration from doing anything other than to raise new taxes and fees. They have been funded this year through the budget that we passed some time ago. They're not prohibited from doing anything other than raising the fees and other charges that we might -- that they might conceive of.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:Thank you.
Actually, in the budget this year there are sunsets on a number of New York State existing energy programs set to expire at the end of the 2015.
So if this bill set up a new time frame for the state to be able to move forward with their new energy proposals, but in December 2015 a series of older programs are expiring, does -- might the sponsor share my concerns that we'll actually go through some period of time without the old programs and without new programs?
SENATOR DeFRANCISCO: No.
SENATOR KRUEGER:Through you, Mr. President, if the sponsor would continue to yield.
SENATOR DeFRANCISCO: Yes.
SENATOR KRUEGER:The bill isn't that explicit about defining the cost-benefit analysis to be done. Would it include non-economic and non-energy benefits such as reductions in greenhouse gases, reductions in respiratory illnesses, decreased CO2 emissions, and improving the state's targeted goals of addressing climate change here in the State of New York? Will that be part of the cost-benefit analysis?
SENATOR DeFRANCISCO: Part of the cost-benefit analysis is exactly what the administration said that they were going to do before -- and that -- in the report that they were supposed to issue by now. We're not making any greater requirements or lesser requirements.
Again, we want accountability to the taxpayer and ratepayers, and we want to know what's going to happen financially before we get too far into this proposal.
SENATOR KRUEGER:Through you, Mr. President, will the sponsor continue to yield?
SENATOR DeFRANCISCO: If there's any more relevant questions.
(Laughter.)
SENATOR KRUEGER:That's in the eye of the beholder, don't you think, Mr. President?
SENATOR DeFRANCISCO: I agree.
SENATOR KRUEGER:Thank you.
Does the sponsor -- is the sponsor concerned that the state is in fact falling further and further behind our need to decrease CO2 emissions and speed up the process by which we are shifting to sustainable forms of energy and expansion of our power grid to ensure that we can meet the needs of the State of New York, keep consumer prices under control, but also significantly decrease pollution being caused by various sources of energy in the State of New York?
SENATOR DeFRANCISCO: No. And the reason I say no is the administration could avoid all these delays that you've been talking about if they would meet their self-imposed deadlines.
We want the information before we go too much further. But it's no more than the administration could -- than you should be concerned about the administration not providing the information that they've promised and not provided in a timely fashion.
SENATOR KRUEGER:On the bill, Mr. President.
ACTING PRESIDENT BOYLE:Senator Krueger on the bill.
SENATOR KRUEGER:Thank you.
So like has been discussed about any number of issues this week between the sponsor and I, sometimes we don't disagree as much as we appear to. And in fact I share the sponsor's concern that the administration is several months behind in getting us information.
We all deserve the information. The public deserves the information. I actually think the hearing that was cosponsored by two committees of the Senate, I guess two weeks ago, was a valuable opportunity to hear from the administration and to hear from others in the impacted community. So I'm glad we did that.
The day before that hearing there was another hearing on climate change issues for the State of New York and the level of crisis, in fact, we find ourselves in.
So I agree with the sponsor that the administration should in fact get all reports to us in a timely way. Where I don't agree with the sponsor, and the reason that I urge people not to vote for this bill, is it sets up a new set of requirements that I have no doubt will delay the state from being able to move forward with some very critical goals that we're already behind on.
And I'm concerned that the way the bill is written, there are so many new steps for accountability and separating out the different projects and itemizing, that it will delay the state far longer than even the one-year timeline written into the bill.
New York State has a target towards the goal of reducing climate pollution 80 percent by the year 2050. And REV in its totality, because it's many different pieces, actually adds up to an estimated $30 billion of replacement of the state's aging energy infrastructure over the next 10 years.
I want the information, just like the sponsor. I just don't want to put us further behind a target we're already too far behind.
And so to demand that the Legislature gets information in a timely way, absolutely. Perhaps to invite the administration to monthly or quarterly hearings where we ask questions in advance and expect to get the answers from them, and have the public come in and listen and raise additional issues, is a rational way to try to hold them to meeting their deadlines.
But to do a "nothing happens until all the answers are provided," perhaps within a one-year time frame, but perhaps within a much longer time frame -- because I have a number of memos here that highlight why they don't think, the way the requirements are put into the bill, anybody could meet these standards -- I don't think that's a win for the State of New York.
I want us to have a 21st-century energy grid, alternative and sustainable sources of energy, broader and redundant options because of the demands on us and our communities, the issues of risk during superstorms and other things caused by exactly the climate change we need to slow down if not potentially reverse.
So I appreciate the sponsor's frustration. It's not on this issue alone. We would love to get all of our reports done on time. I think we could make a very long list of where those reports are long overdue. But I don't want to see the State of New York stop or slow down the momentum that is clearing building towards our accomplishing these enormous and critical goals.
I urge a no vote. Thank you, Mr. President.
ACTING PRESIDENT BOYLE:Thank you, Senator.
Senator Hoylman.
SENATOR HOYLMAN:Thank you, Mr. President.
I do appreciate the sponsor for having a forum, a hearing on this matter.
You know, I am opposing this bill for a number of reasons. One, because it's essentially duplicative of what already exists.
The REV plan is essentially, Mr. President, a cost-benefit analysis. And by imposing yet another cost-benefit analysis on an existing cost-benefit analysis I think doesn't contribute at all to the conversation. It's just a diversion.
More importantly, though, is that, as my colleague mentioned, New York has a goal to reduce carbon emissions by 80 percent by the year 2050. Colleagues, we have to get cracking on that goal. We are way behind. In fact, what we should be doing in this body, rather than imposing new what I'd call phony cost-benefit analysis, we should be setting benchmarks and understanding how close we are to achieving that goal. We're not doing that, and we should be codifying that 80/50 goal into law.
What concerns me is that there is, sadly, an ulterior motive here, which is some misconception that the upstate power plant grid is going to be not part of the state's overall solution in climate change. And I don't think that's accurate. I think that REV is looking at how we can incorporate transmission into a clean and green energy plan. It's a very important part of us meeting the 80/50 goals, and we should be supporting the administration and moving forward rather than trying to create obstacles.
So I'll be voting no.
ACTING PRESIDENT BOYLE:Are there any other Senators wishing to be heard?
Seeing none, the debate is closed. The Secretary will ring the bell.
Read the last section.
THE SECRETARY:Section 4. This act shall take effect immediately.
ACTING PRESIDENT BOYLE:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT BOYLE:Senator Griffo to explain his vote.
SENATOR GRIFFO:Thank you, Mr. President.
I think essentially today we are mindful of the fact that there are many challenges that confront this state. We want to continue to see business grow in this state and people to be able to live in this state. And we know those challenges are taxation and regulatory climate and the high cost of energy. And it's important -- and we recognize the need and the significance of an energy plan and a diversified energy portfolio.
But we also recognize that many initiatives begin, such as the Energy Highway, and have stalled. And that is very important too, that we continue to keep that focus on that issue, as presented earlier on, as well as Reforming the Energy Vision.
So I think what this bill is doing today is to ensure that the administration continues to communicate, complies with the deadlines that have been established so that this Legislature and the people have the information necessary in order to make intelligent decisions. There needs to be an element of accountability and transparency. And most important, we need to keep in mind how these energy costs ultimately affect the ratepayer that we all represent and the businesses we want to keep in this state.
For that reason, I vote aye, and I urge everyone else to do likewise.
ACTING PRESIDENT BOYLE:Senator Griffo to be recorded in the affirmative.
Senator DeFrancisco.
SENATOR DeFRANCISCO: Yes, I just want to mention in response to some of the comments that this is not a duplication of what's going on right now, because what's going on right now isn't going on.
The deadlines are not being met. And this says we really want to see this stuff, and as a Legislature we need it in order to go forward on this particular REV vision.
So with that said, I urge everyone to vote aye as well.
ACTING PRESIDENT BOYLE:Senator DeFrancisco in the affirmative.
Announce the results.

Therefore, we're going to technically remain in session. However, there's no further business. And after we close down getting the rest of the amendments, which is all that really is left to be done, we will be adjourned until Monday, whatever Monday is, at 3:00 p.m., intervening days being legislative days. Oh, excuse me, 2:00 p.m. on Monday. Intervening days are legislative days. And Monday is the -- what day of June? I'm just testing you. The 15th day of June.
And there are also going to be some committee hand-ups. But those who want to leave because there's no real business being done, you're certainly welcome to do so. And we'll close down as soon as those administrative matters are put on the record.
